2 The French ports reform 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”2 French ports reform: a process with 4 steps: ► The first step : law n° 1992-496 of the 9 th of June 1992 - dockworkers reform; dockworkers pools disappear and dockworkers become staff of the stevedoring companies ► The second step : law n° 2004-809 of the 13 th of August 2004- transfer from the State to local authorities of the port of national interest (except the autonomous ports) ► The third step : law n° 2008-660 of the 4 th of July 2008- autonomous ports  7 large maritime ports (reform of governance and missions) ► The fourth step : law n° 2012-260 of the 22 nd of February 2012- reform of the French overseas ports

3 The 2 nd step of the French ports reform 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”3 General rule for local ports: – commercial ports belong to the “Régions” – fishing ports belong to the “Départements” – recreational ports belong to the Cities The 2004 law gave the opportunity to a Region or to a group of local government to deal with commercial ports.

5 The 3 rd step of the French ports reform: 2008-2012 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”5 ► The French challenge: only 1 container of 2 from/to France is loaded/unloaded in a French port ► Aim of the reform: to achieve the partial dockworkers reform undertaken in 1992 ► The means: by developing previous “autonomous ports” as landlord ports

7 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”7 1- Port Governance new tools for large maritime ports (LMPs): operating since 2008 for 7 ports –Supervisory Board –Executive Board –Development Council –Scientific Estuary Councils 2- For several LMPs cooperation tools –Seine ports: Paris- Rouen- Le Havre (15th of October 2009) –Atlantic ports: Nantes-Saint Nazaire, Bordeaux, La Rochelle (4th of December 2009) The 3 rd step of the French ports reform: 2008-2012

8 The social acceptance of the 3 rd step 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”8 Social acceptance : After 53 meetings a general understanding agreement was passed in 2008 and taken into account as a governmental decree ( n° 2008- 1240 of the 28 th of November 2008 )with three main components: 1)Crane drivers and crane maintenance workers will carry on their jobs within the stevedoring companies with a guarantee that in case of misfortune the port will take them back (14 to 25 years) 2)The previous national collective agreements stemming from the two branches (stevedoring companies and ports) are merged together : a new wages grid was built up. The new national collective agreement entered into force on the 3d of May 2011 and is compulsory for each port company or authority since the 17 th of August 2012 3)A special agreement on early retirement for some hard port jobs has been passed in April 2011 after strong discussion due to the coincidence with the general pension reform

9 Conclusion 1 st of October 2012 - AthensWorkshop "Regulatory Framework for Greek Ports”9 ► The French port system: comparable to the European port system ► End of the reform: the main operating activities have been transferred mid 2011 ► First results: container throughputs have strongly increased since the beginning of 2012
