Spill Prevention Control and Countermeasure Plans (SPCCs) for Agricultural Facilities & Dealers
Aboveground Petroleum Storage Act (APSA) Assembly Bill 1130 (Laird) Chaptered October 13, 2007 SUMMARY This bill: Transfers the responsibility for the implementation, enforcement, and administration of the Aboveground Petroleum Storage Act (APSA) from the State Water Resources Control Board (SWRCB) to the Certified Unified Program Agencies (CUPAs) effective January 1, 2008.
Who is subject to the requirements of APSA? A tank facility is subject to APSA if: The tank facility is subject to the oil pollution prevention regulations specified in part 112 (commencing with section 112.1) of subchapter D of chapter I of title 40 of the Code of Federal Regulations; or the tank facility has a storage capacity of 1,320 gallons or more of petroleum. Important Note: The California APSA only regulates tank facilities that store petroleum and not other oils, as does the federal SPCC Rule (subject to 40CFR112). The Acts definition of petroleum and tank facility must first be applied before considering the first applicability criteria above.
What is a tank facility? For the purposes of APSA, a tank facility is defined as any one, or combination of, aboveground storage tanks, including any piping that is integral to the tank, that contains petroleum and that is used by a single business entity at a single location or site.
What is petroleum? The Act defines petroleum to mean crude oil, or any fraction thereof, which is liquid at 60 degrees Fahrenheit temperature and 14.7 pounds per square inch absolute pressure (normal atmospheric pressure at sea level). Some examples of petroleum products stored in aboveground storage tanks and are subject to APSA are as follows: Petroleum-based liquid fuels*, including: o Aviation fuels (including jet, turbine, and piston fuels) o Automotive and other petroleum-based internal combustion engine fuels o Fuel oils and distillate fuels (turbine, boiler, and other types o Heating oil and distillates o Illuminating (e.g. lamp) oils Gasoline and other fuel blending stocks Petroleum-based lubricating, tapping, seal, penetrating, machining, and road oils and greases (including waste oils) Petroleum distillates
Petroleum- or petroleum-distillate based additives (including fuel, oil, ink and paint additives) Petroleum solvents Petroleum spirits (e.g. mineral spirits, Stoddard solvent, paint thinners, etc.) Hydrocarbon liquids Naphthas and naphthalenes of all types Olefins, alkanes, alkylates, aromatics Petroleum-based inks and ink extenders Oil-based paints, coatings, thinners and solvents Petroleum extender oils Mineral oils (derived from petroleum) Crude oil * Note: Fuels which are not liquid at 60oF and atmospheric pressure (such as propane, liquid natural gas (LNG) and liquid petroleum gas (LPG)) are not considered petroleum under the APSA definition. Additionally, 100% vegetable or plant-based fuels or liquids (such as corn ethanol or biodiesel) are NOT regulated under APSA unless the fuel or liquid contains 1% or greater concentration of petroleum (such as E85 gasoline or B20 biodiesel, which contains over 1% petroleum).
Spill Prevention Control & Countermeasure Plan (SPCC) -The SPCC rule describes requirements for certain facilities to prepare, amend, and implement plans for the prevention of oil spills to navigable water whenever quantities of petroleum are handled. In California, the SPCC Plan is implemented to prevent spills into the waters of the State. -Details the equipment, workforce, procedures and steps to prevent, control and provide adequate countermeasure to a discharge.

What tank facilities are exempt from the APSA program? A tank facility located on a farm, dairy, nursery, logging site, or construction site, while still regulated under APSA, is not subject to the requirement to prepare and implement an SPCC Plan if: -no storage tank at the location exceeds 20,000 gallons; and, the cumulative storage capacity of the tank facility does not exceed 100,000 gallons.
The owner or operator of an exempted tank facility located on a farm, nursery, logging site, or construction site, is required to take the following actions: -Conduct a daily visual inspection of any aboveground tank storing petroleum. -Allow the UPA to conduct a periodic inspection of the tank facility. -If the UPA determines installation of secondary containment is necessary for the protection of the waters of the state, install a secondary means of containment for each tank or group of tanks where the secondary containment will, at a minimum, contain the entire contents of the largest tank protected by the secondary containment plus precipitation.
Under APSA, farms are conditionally excluded from the APSA requirement for tank facilities to prepare an SPCC Plan. However, APSA-excluded farms are not exempt or excluded from regulation under federal SPCC rules. In both the December 2006 and November 2008 amendments to the Federal SPCC rule, EPA has provided specific instructions to farms in complying with the SPCC Plan requirements, which are: Farms starting operation… Must... On or before August 16, 2002: Maintain its existing Plan Amend and implement the Plan when EPA promulgates a rule specific for farms and specifies a compliance date for farms After August 16, 2002 :Prepare and implement a Plan when EPA promulgates a rule specific for farms and specifies a compliance date for farms
Who prepares the Plan? Preparation of the Plan is the responsibility of the facility owner/operator, but it must be certified by a Professional Engineer, (unless your facilitys oil storage capacity is 10,000 gallons or less).
Is it a requirement for tank facilities to submit, file or provide their SPCC Plans to the CUPA, or for the CUPA to approve the Plan? No. The APSA only requires a tank facility to submit/file an annual Tank Facility Statement with the CUPA. **** FYI – Business plans can be used in lieu of this statement under certain conditions. There is no requirement in APSA for a tank facility to submit or file its SPCC Plan itself. However the UPA may require a copy of the SPCC Plan to be submitted as part of the UPAs city/county ordinance or policy. There is also no requirement in APSA for a tank facilitys SPCC Plan to be approved by the CUPA. Federal regulations (40 CFR 112) also do not require the routine submittal, filing or approval of an SPCC Plan (although a Plan may be required to be submitted to USEPA after certain significant oil spills into navigable waters).
Who can sign or certify an SPCC Plan? Either a registered Professional Engineer or the owner or operator of a specified tank facility may certify a tank facilitys SPCC Plan. The tank facility must meet the qualifications as a qualified facility, in order for the owner or operator of the tank facility to be permitted to self-certify the SPCC Plan. Pursuant to the definition of a qualified facility in section 112.6 of title 40 of the Code of Federal Regulations, in order to qualify as a qualified facility, the facility must meet all the following criteria: -have a total facility storage capacity that is less than 10,000 gallons; and within the past three years, have had no single discharge to navigable waters exceeding 1,000 gallons or no two discharges to navigable water each exceeding 42 gallons within any rolling twelve month period over the past three years. (In California, storm drains are generally considered navigable waters.)
Can a facility use an SPCC Plan template? In general, an SPCC Plan must be prepared in accordance with good engineering practice. No specific format is required, but if the Plan is not organized to follow the sequence of the requirements in 40 CFR 112, it must have a cross- reference. As long as the Plan contains all the required 40 CFR 112 elements, is facility-specific and is prepared in accordance with good engineering practice, any format may be used.
Who reviews the SPCC Plan and how often is the SPCC Plan reviewed? The owner or operator is required to review the SPCC Plan at least once every five years. Every review must be documented. When must an SPCC Plan be amended by the facility operator? The owner or operator is required to amend the Plan within six months following a review to incorporate more effective control and prevention technologies if the technology will significantly reduce the likelihood of a release, and the technology has been field-proven at the time of review. The owner or operator must also amend the SPCC Plan as described in 40 CFR 112.5, whenever there is a change in the facility design, construction, operation or maintenance that materially affects the facility's potential for discharge into navigable waters of the United States or adjoining shorelines.
Can I self-certify my SPCC? In December 2006, EPA amended the Spill Prevention, Control, and Countermeasure (SPCC) rule to streamline some of the requirements for facilities with smaller oil storage capacity and for specific types of equipment. The revised rule provides an option for qualified facilities to prepare a self-certified SPCC Plan instead of one that is reviewed and certified by a Professional Engineer (PE). These facilities may also use newly revised facility security and tank integrity inspection requirements that are tailored for qualified facilities without PE certification.
What is a qualified facility? A qualified facility is a facility with a limited oil storage capacity that is eligible for streamlined regulatory requirements. A facility must meet two conditions to take advantage of the qualified facilities option. First, the facility must have 10,000 gallons or less in aggregate aboveground oil storage capacity. Second, the facility must not have had (1) a single discharge of oil to navigable waters exceeding 1,000 U.S. gallons, or (2) two discharges of oil to navigable waters each exceeding 42 U.S. gallons within any twelve-month period, for the three years prior to the SPCC Plan certification date, or since becoming subject to 40 CFR part 112 if the facility has been in operation for less than three years. When determining the applicability of this criterion, the gallon amount(s) specified (either 1,000 or 42) refers to the amount of oil that actually reaches navigable waters or adjoining shorelines, not the total amount of oil spilled.

If you modify the template, your Plan must include a section cross- referencing the location of each applicable requirement of the SPCC rule and you must ensure that your Plan is an equivalent Plan that meets all applicable rule requirements of 40 CFR 112.6(a)(3).
