2 IDR Operations Concept Japan Disaster Relief Law
International disaster relief operations increase humanitarian contribution - create a more stable security environment Japan Disaster Relief Law 1987 JDR Law was enacted   Japan has engaged in international disaster relief activities when large-scale disasters have occurred oversea 1992 JDR Law was amended to enable the SDF to participate   when foreign minister deems it particularly necessary Since then, the SDF has maintained its readiness for IDR operations with its self-sufficient capability. 1st of all IDR Operations Concept is increase humanitarian contribution and- create a more stable security environment IDR operations legal base is the Law Concerning the Dispatch of International Disaster Relief Teams (so-called JDR Law) Outline of IDR Low as follows in 1987 , Since the International Disaster Relief Law was enacted in Japan has engaged in international disaster relief activities when large-scale disasters have occurred oversea in response to requests from the Governments of affected countries. In 1992, the International Disaster Relief Law was amended to enable the SDF to participate in international disaster relief operations. Since then, the SDF has maintained its readiness for international disaster relief operations with its self-sufficient capability.

PROCEDURES Our Disaster Relief Operations are based on the Request of the Receiving Countries or International Organizations Foreign Minister consults with Defense Minister. Defense Minister orders the SDF to dispatch its units Now I shall touch upon the outline of IDR operations by the Japan Self-Defense Forces. First, I would like to explain procedures of the Japan Self -Defense Forces Units. Our Disaster Relief Operations are based on the Request of the Receiving Countries or International Organizations When Foreign Minister considers that dispatch of SDF units necessary, Foreign Minister consults with Defense Minister about dispatch of JSDF units. Then, Defense Minister orders JSDF to dispatch its units based upon above-mentioned consultation. JSDF’s IDR activities are conducted mainly in the area of Asia-Pacific region. Next slide please AREAS Mainly the Asia-Pacific region

4 Ensuring water supplies using water-purifying devices
FIELDS OF IDR Medical Services such as first aid medical treatment and epidemic prevention Transportation of goods, patients and disaster relief personnel by helicopter, etc. Ensuring water supplies using water-purifying devices Fields of  IDR by the JSDF units can be as follows. First, medical services, such as first-aid medical treatment and epidemic prevention, can be offered. Second, the JSDF units can transport goods, patients and DR personnel by helicopter and so on. Third, ensuring water supplies using water-purifying devices can be conducted. In addition, the JSDF may use transport planes and transport ships for relief activities. 5 MAJOR OPERATIONAL POLICY
First dispatch within 48 hours Second dispatch within 5 days Arrival within approx. 2 weeks Unarmed PERIOD OF ACTIVITIES Major operational policy is as follows. The first dispatch, that is, an advance party, shall depart within 48 hours after the order. The second dispatch, that is a main body, shall subsequently start to depart within 5 days. Contingent should arrive in the disaster area within about 2 weeks. And Estimated Periods of activities can be about 3 weeks after the arrival of the second dispatch. Medical, survey & liaison unit (including 2 doctors) Second dispatch: Medical unit (including 11 doctors), 3 of UH-1s, 3 of CH-47s ,2 of Supply water sets MSDF 1 of AOE,  1 of LST,  1 of DD/DDH This is UNIT READINESS The following units are in the readiness for international disaster operations; GSDF For first dispatch, is Medical, survey and liaison unit(including 2 doctors). For second dispatch, is Medical unit(including 11 doctors), 6 helicopters, 2 supply water sets, MSDF 1 of AOE,  1 of LST,  1 of DD/DDH 3 ships ASDF 6 of C-130Hs Until last year C-130s ware released from readiness during the period of supporting [ Operation Iraq Freedom}. 8 IDR Operations at off Sumatra and Indian Ocean(2004)
○ 26th of December  Occurred a big earthquake west off Sumatra Island of Indonesia and a tsunami in the  Indian Ocean ○ 27th of December    Thai Government requested an aide to the Japanese Government ○ 28th of December   Request from Foreign Minister, MOD decided to dispatch the MSDF vessels ○ 3rd of January   Request by the Indonesian Government Japan dispatched on SDF units   ○ 6th of January   ASDF’s Airlift units, MSDF’s maritime units, and GSDF’s medical units to devastated areas mainly Banda Aceh, Indonesia. this is IDR Operations to respond to the large-scale earthquake off Sumatra and tsunami in the Indian Ocean In 2004 On 26th of December occurred a big earthquake west off Sumatra Island of Indonesia and a tsunami in the Indian Ocean. It inflicted a huge damage upon people and land of the areas. On 27th, the Thai Government requested an aide to the Japanese Government, on 28th, in responding to the request from Foreign Minister, Minister of State for Defense decided to dispatch the MSDF vessels on the way back to Japan after completing their mission based on anti-terrorism law, to turn their route toward Thailand rapiedy. Besides, in responding to the request by the Indonesian Government on 3rd of January, Japan dispatched on SDF units after 6th of January the ASDF’s Airlift units, the MSDF’s maritime units, and the GSDF’s medical units to devastated areas, mainly Banda Aceh, Indonesia.

27th May: Earthquake occurred in the vicinity of Indonesia/Java Island 28th May: GOJ determined to supply emergency relief, to dispatch JICA team. 29th May: JDA directed preparation for dispatch 30th May: JDA dispatched advance party 31st May: JDA directed order for dispatch 1st June : JGSDF Medical unit departed on JASDF C-130x2 and commercial aircraft 2nd June: JGSDF Medical team arrived at damaged area and started relief operation. Issued additional unit order. 4th June: Additional medical unit departed on JASDF C-130x2 and commercial aircraft 5th June: Additional Medical unit arrived at damaged area and started relief operation. 13th June: JDA directed redeployment order. 16th June: The relief operation on site ended. 16 LEGAL ISSUE IDR must be rapid but must be very careful
In Case of accident various Legal Issue will occur   In Civil case How to Settle various claims for damage or loss How to treat Civil liability How to conduct necessary investigation In Criminal case How to exercise Criminal jurisdiction How to treat suspect and persons concerned Effectiveness of professional licenses Others Usually IDR request Rapid deployment and operation but must be very careful because  In Case of Accident various Legal Issue will occur   for example SDF aircraft crash during IDR OP and injure local Person ,or damage local persons property In Civil case How to Settle various claims for damage or loss How to treat Civil liability How to conduct necessary investigation and In case of settlement failure How to treat Civil action and Civil procedure In Criminal case How to exercise Criminal jurisdiction and prosecution How to treat suspect and persons concerned during IDR OP Effectiveness of professional licenses such as Driver, flight , doctor licenses valid by appropriate government Others LEGAL ISSUE are CIQ for rapid operation customs , immigration ,quarantine inspection Must be simplification

17 Measures to enable smooth IDR
Rapid deployment Information sharing, among many actors Cooperation and coordination with each other Establishment of temporary coordination center Capability building such as ARF IDR EX Next is Measures to enable smooth IDR As you know Rapid deployment is very important Quick request and prompt action is desirable especially In case of no request Japan can not deploy sdf information, Sharing among many actors In the relief operation, information , such as situation of disaster area, relief needs,and current situation of other relief unit , was needed. For information gathering, and information sharing among many actors is important Cooperation and coordination each other coordination of the activities with the militaries of different countries and mutual support in logistics with foreign contingents could have been useful for the operations Establishment of temporary coordination center appropriate organization such as the Combined Coordination Center had worked well and effectively. Capability building such as ARF HADR EX Is important SDF every year participate CGEX and conducting joint training exercises(CPX )for IDR OP Lastly, We need some legal framework for legal issue For the purpose of improving the speed of multinational crisis response and the effectiveness, the strategies and procedures, such as SOP should be developed. And it would be beneficial to take steps to improve the effectiveness of communication among aid personnel not only militaries, but also in governments, international organizations, and NGOs that will actually carry out relief activities by exchanging views
