2 2 The Care Bill: reforming care and support Transition from children’s services New provisions to support better transition to adult care and support: Duties for local authorities to assess young people and young carers under the adult statute in advance of their 18 th birthday, to prepare for transition where the young person is likely to have needs. A duty to assess the adult carers of disabled children, to identify any support needs, and prepare for transition of the child. No age limits, only that assessment must be of “significant benefit” to the individual – so there is flexibility to assess whenever is best. A power to provide support to meet the needs of adult carers of children. A duty to ensure continuity of care around transition – so that if a young person is receiving services on their 18 th birthday, but adult care and support is not ready, they must continue to receive the same service.

3 3 The Care Bill: reforming care and support Consultation questions 57.Is the guidance clear enough that the term ‘significant benefit’ is about the timing of the assessment? Is the guidance precise enough to ensure that ‘significant benefit’ is not open to misinterpretation and that people who should be assessed are assessed at the right time for them? 58.Are the descriptions in the guidance of people’s rights to transition assessments and continuity of care beyond 18 sufficiently clear?
