3 INTRODUCTION The developments in science and technology have certainly contributed to improvised global health care and the life span of the human beings world wide has seen upward progression. The technological developments, on the other hand, have been misused for the production of powerful psychotropic substances and in modification of narcotic drugs which are being misused by a considerable parts of the global population

4 In the present day, drugs like heroin, brown sugar, smack and a lot more have been added to the list of habit forming drugs. It was to counter procurement, manufacture and trade of such harmful substances, a new Act NDPS (1985) was enacted, with keeping in view the recommendations of various International Conventions

5 OBJECTIVES OF NDPS ACT:
1.To consolidate and amend the law relating to narcotic drugs. 2.To make stringent provisions for the control and regulation of operations relating to narcotic drugs and psychotropic substances. 3.To provide for the seizure of property derived from or used in illicit traffic in narcotic drugs. 4.To implement the recommendations of the International Conventions on narcotic drugs and psychotropic substances.

6 DEFINITIONS: Cannabis: means any plant of genus cannabis
Addict: means a person addicted to any narcotic or psychotropic substances. Cannabis: means any plant of genus cannabis Charas, is the separated resin from the crude or purified form from the cannabis plant. Ganja, is the flowering or fruiting tops of the cannabis plant.

7 Coca derivative/ Coca plants: means any species of the genus erythroxylon
Crude cocaine: any extract of coca leaf which can be used, directly and indirectly, for manufacturing of cocaine b) Ecgonine and all the derivatives of ecgonine from which it can be recovered

8 Controlled Substance: means any substance which the government may, having regard to the available information as to its possible use in the production or manufacture of narcotic drugs and psychotropic substances, by notification in the Official Gazette. Narcotic Drugs: is a drug made from or derived synthetically from opium and includes all manufactured drugs. Example: opium, morphine, heroin, codeine, hydrocodone, fentanyl, meperidine, oxycodone, tramadol, nalbuphine, pentazocine, and many others.

9 Opium: means The coagulated juice of the opium poppy Preparation containing not more than 0.2% of morphine Psychotropic substances: means any substance, natural or synthetic, A drug that affects emotional state. Psychotropics include antidepressants, sedatives, stimulants, and tranquillizers.

10 Illicit traffic: in relation NDPS Act means,
(a) Cultivating or gathering any portion of coca plant. (b) Cultivating opium poppy. (c) Engaging in the production, manufacture, sale, purchase, transport, import, use of narcotic drugs or psychotropic substances. Manufactured Drugs: it means all coca derivatives, medicinal cannabis, opium derivatives and poppy straw concentrate.

11 PROHIBITION, CONTROL AND REGULATION OF NDPS
No person without the permission of the Central Government shall a) Cultivate coca plant or gather any portion of it. b) Cultivate opium poppy or cannabis. c) Produce, manufacture, sell, purchase, transport, warehouse, use, import and export any NDPS except for medicinal and scientific purpose with Government approval.

12 The Government will fix the following:
1. Time frame for cultivation of opium. 2. Regulations for delivery of opium by cultivators. 3. Fix prices to be paid to cultivators. 4. Issue permits for manufacture, possession, export, etc. 5. Appoints officers for inspection. 6. Declares the place for cultivation and warehouse for poppy straw.

13 CULTIVATION OF OPIUM: Opium cultivation can be done only on behalf of the central government in the notified tracts. Application need to be given for the grant of license by giving fees. The license shall specify the area and designated plots to cultivate opium poppy. The officer may designate one of the cultivators of opium poppy for the same purpose.

14 The cultivator shall perform such functions on terms and conditions prescribed by the Narcotic Commissioner. The license can be cancelled or withheld for sufficient reason to be given by the licensee to the Opium Officer. In case a license is withheld or cancelled, the standing crop, if any, shall be destroyed under the supervision of the proper officer. Destruction procedure is specified by the Narcotic Commissioner.

15 During the course of harvesting, the cultivator shall produce daily before the Officer each days collection of opium. Daily record shall be maintained by the cultivator and the officer.

16 APPLICATION FORM FOR CULTIVATION OF OPIUM
The following information is to be furnished in the application: 1. Crop year 2. Name and address of the cultivator 3. Plot number on which opium poppy is to be cultivated. 4. Whether the plot is in his name and if not, in whose name?

17 5. Is the plot having irrigation facilities.
6. Area required for cultivation. 7. Whether the applicant has cultivated opium in past, if so details. 8. Any objections from the cultivator regarding opium poppy cultivation. 9. Signature of the cultivator and the Officer.

18 CONDITIONS ON OPIUM LICENSE:
The license is subjected to following conditions: i. The licensee can not transfer his license. ii. Cannot cultivate opium over the area of land not specified in the license. iii. The licensee gets his daily collection of opium to the officer and signs on each entry into the document. iv. The land for cultivation shall be free of litigation.

19 v. Licensee shall bring all the cultivated opium to a designated place for weighing and submission. vi. The licensee shall deliver the opium in presence of an opium officer authorized. vii. If licensee violates any rules regarding cultivation and disposing, shall be liable for prosecution. viii. The licensee shall extract as much opium as normally possible.

20 ix. The licensee shall comply with the provisions of
the Narcotic Drugs and Psychotropic Substances Act. x. The license may be cancelled or withheld anytime for any reason. xi. Breach of any of the conditions of the license is punishable.
