3 Citation No. 8800557 - Issued under the provisions of 104(a) of the Mine Act for violation of 30 CFR § 46.7(a): On March 27, 2014, a serious accident occurred when an excavator was used to move an 8-inch diameter plastic suction pipe to a new pumping location and the unsecured pipe fell off the excavator bucket striking the victim in the head. The victim died three days later, as a result of the injuries. At the time of the accident, management failed to establish procedures to ensure that persons could move the slurry pipe from place to place in a safe manner. Although the mine operator had a written Part 46 training plan in place, all of the victim’s training had been conducted at another company-owned mine and did not address site-specific hazards at this mine. There was no evidence to show that the victim and other employees at this mine received adequate task training in safe operating procedures related to the assigned task as Fatalities Related to Task Training

Citation No. 8761865 - issued under the provisions of Section 104(d)(1) of the Mine Act for a violation of 30 CFR 46.7(a): Harold Steege, a Truck Driver and the victim of the fatal accident that occurred on April 17, 2014, had not received complete MSHA-required task training, including the safe work procedures of staying in the equipment while in the active load out area. The mine operator was aware of the Part 46 training requirements. The Federal Mine Safety and Health Act of 1977 states that an untrained miner is a hazard to himself and to others. Management engaged in aggravated conduct constituting more than ordinary negligence in that they were aware of the training requirements and directed Steege to operate the truck, yet failed to provide the required training prior to Steege’s assuming those duties. This violation is an unwarrantable failure to comply with a mandatory standard.

5 Fatalities Related to Task Training Order No. 8638724--issued under the provisions of Section 104(d)(1) order of the Mine Act for a violation of 30 CFR 46.7(a): Task training was not provided for the task of removing the impeller on slurry pumps. The victim and contractor miners were working to remove an impeller from a slurry pump which was seized onto the threaded shaft, when heat from the torch was applied the impeller exploded, killing the Production Supervisor. Management engaged in aggravated conduct constituting more than ordinary negligence by not providing task training for this task. This is an unwarrantable failure to comply with a mandatory safety standard. This violation is an unwarrantable failure to comply with a mandatory standard.

6  The training plan must include:  + each task,  + teaching methods to be used,  + training materials, and  + evaluation procedures.  Plans may list each task with corresponding teaching methods, training materials and evaluation procedures. A plan may also group a number of tasks together with a general listing of teaching methods, training materials and evaluation procedures.  Remember, the plan must also identify the competent person(s) that will conduct the task training and the approximate time to be spent on each task (see discussion of competent persons on page 8).

7 Ensure the following: The mine has established an adequate task training program Task training is performed on all machines and job duties Adequate task training records are completed for all task training Task training is performed on all maintenance activities Task training is provided when there is a change to the equipment, process, or condition 7

8 Utilize the following: Equipment or job checklists, job safety analysis, or safe job procedures Operator’s manuals are utilized to determine specific hazards related to the equipment Established communication procedures for task trainers Maintain an adequate task list in the training plan Development of an action plan to address any changes to equipment, process, or condition 8

9 Evaluate the following: There is adequate time set aside to complete thorough task training Miners ability to demonstrate the knowledge of company and federal health and safety procedures applicable to all tasks Task Training was completed in a “non-production” setting Supervised practice of task training in a production mode The trainees knowledge of locating and utilizing the company’s HazCom program and MSDS’s Miners perform pre and post operation checks on the equipment

10 Miners knowledge of any required maintenance and service of equipment Understand how and where to report any problems or malfunctions The trainees ability to demonstrate proper start-up and shutdown procedures of equipment Miners have received the proper skills necessary to perform tasks in a safe manner Miners demonstrate safe operating procedures, and know the proper procedure to address any change to the equipment, process, or condition 10

11 Establish guidelines for trainers: Utilize checklists, job safety analysis, operator’s manuals, and safe operating procedures All task trainers have been trained and have the necessary skills to perform adequate and efficient task training Ensure task trainers have received formal or informal training to perform effective task training All task trainers provide uniformity and consistancy in training for all equipment and job duties Evaluation procedures to determine that all health and safety aspects of the tasks are addressed in a correct and consistent manner Conduct follow up evaluation of task training, and implement any training necessary to address a change to the equipment, process, or condition 11
