1 The Republic of Sudan Ministry of Finance & National Economy General Directorate for Public Procurement, Contracting & Disposal of Surplus Public Procurement Regulation

2 Overview Till February 2010 public procurement was regulated by the provisions of the Accounting & Financial Regulations issued in 1978, as amended in1995. The Procurement, Contracting & Disposal of Surplus Act was issued in 2010. The Act embodies International and Regional experiences. The Act’s Regulations were issued in 2011.

3 Main provisions Emphasizes on open competition, transparency and economic efficiency. Mandatory for all Government Units. Government units include state participation in entities ownerships exceeding 20%. Formed the General Directorate for Procurement, Contracting & Disposal of Surplus (the “Directorate”).

4 Main provisions, cont. Addressed: Prohibited Actions. Penalties. Revision and Appeal. Higher Committee for Appeals. Appeal procedures and decisions.

5 Main responsibilities of the Directorate Develops policies and undertake researches. Oversees, and reports on, implementation. Participates in Procurement Committees. Trains procurement staff. Issues Standard Bidding Documents. Reviews procurement activities of Government Units. Oversees disposal of public assets.

6 . Procurement Units To be established in major Government Units. Recruit appropriately qualified staff. Plan and coordinate. Secretariat to Procurement Committees. Maintain relevant documentation.

7 . Procurement Committees To be established in major Government Units. Appropriately qualified and experienced staff. Membership specified by the Act.

8 . Functions of Procurement Committees Set procurement plans forGovernment Units. Perform procurement from start to end. Follow-up execution. Report periodically to the Directorate.

9 . Disposal of Surplus Subject to approval by the Minister of Finance & National Economy. Sets cases and procedures. Close coordination with the Directorate. Supervised by Joint Committee. Funds to be transferred to the Ministry of Finance & National Economy.

10 . Initiatives In-house training. Distribution of the Act and Regulations throughout the country. Training of Trainers, on Federal and State levels, to handle further training needs. Soliciting technical and financial aid, on capacity building, from international and regional bodies.

11 Achievements Issued Standard Bidding Documents, covering: Procurement of Goods Procurement of Works Procurement of Consultant Services As well as the Comprehensive Procurement Procedures Manual.

12 Achievements, cont. Training of Trainers, Directorate and Government Units’ staff. Issuance of directives to staff on practical issues. Regular reviews of procurement operations. Participation in forums, conferences, for exchange of experiences.

13 Challenges Law enforcement. Increasing awareness of Act and Regulations. Proper use of Standard Bidding Documents Adherence to old procedures. Funding of capacity building programs.
