6 6 What can the USPTO do? Steps in the right direction: Favor implementation and investigation. Err on the side of less approvals. Enhance the Obviousness standard: 1. Would this be discovered in the next 6 months without disclosure? If so, don’t grant claim. Why does the industry need it? 2. After 6 months, crowdsource prior art info on sites like http://patents.stackexchange.com/. Prior art must have been created over a month before claim was disclosed to the crowd. http://patents.stackexchange.com/ Open source drives software innovation, based on implementation. Patents are based on disclosure + monopoly restrictions on industry. Effort put into writing software is protected by copyright.
