2  No person in the United States shall, on the basis of sex, be excluded form participation in, be denied the benefits of, or be subjected to discrimination under and education program or activity receiving Federal financial assistance.”

3  Eliminate sex-based discrimination in schools  Ensures that institutions that become aware of discriminatory conduct based on sex take prompt, effective action to address it and prevent it from recurring

4  Sexual harassment that is sufficiently severe interferes with or limits a students ability to participate in the benefits of the schools program  Jeopardizes academic achievement  Undermines physical and emotional well-being  May lead to depression, PTSD, alcohol and drug abuse, and suicidal thoughts

6  1 in 5 college females was a victim of sexual harassment or sexual violence during their college career  9 of 10 victims of rape or attempted rapes knew their assailant  50% of sexual assaults of college students involved the use of alcohol or drugs  Only 2% of incapacitated victims report sexual assault  Only 13% of forcible rape victims report sexual assault

7  What do you think it means?  The Law defines sexual harassment as: Unwelcome sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual nature.  THREE WORDS: UNWANTED, SEXUAL, ACTIVITY

8  Quid Pro Quo  Quid pro quo means an exchange of goods or services, where one transfer is contingent upon the other. English speakers often use the term to mean "a favour for a favour"; phrases with similar meaning include: "give and take", "tit for tat", and "you scratch my back, and I'll scratch yours.”

9  Hostile Environment  Unwelcome conduct that has a sex or gender-based discriminatory effect. Directed at someone based on their actual or perceived sex or because of their masculinity or femininity and is sufficiently severe, pervasive and objectively offensive to cause discriminatory effect.

10 Sexual Violence  Physical sexual acts against a person’s will or where a person is incapable of giving consent (e.g., drugs, alcohol or disability).

12 Consent is positive, unambiguous and voluntary agreement to participate in sexual conduct. NO MEANS NO! Did you know that over 50% Of high school females and over 70% of high school males believe that some form of forced sexual encounter is ok!

13  A person impaired by drugs or any intoxicant  A person who has been compelled by force, threat of force or deception  A person who is unaware that the act is being committed  A person whose ability to consent is impaired because of mental of physical conditions  A person who is coerced by supervisory or has disciplinary authority

14  You must ask the person to stop  Talk to a Title IX coordinator at your school  KNOW your college or university protocol for reporting harassment  Know that this will be taken care of without retaliation

15  Remember: Harassment can be done to anyone by anyone  As a third party person who has seen or is offended by an incident, you have the due diligence of reporting any act of discrimination or harassment  All reporting is completely confidential – all investigation is as confidential as possible

16  Reporting should be done promptly  All complaints should be given to a title IX coordinator  Once the complaint is received, a prompt an impartial investigation will be conducted  Involved parties may be asked to identify witnesses  Investigators will prepare a report that summarizes and analyzes the information obtained

17  To the best of their ability, the college or organization will protect the accuser from any form of retaliation.  An individual who covers up the truth or retaliates against a complainant will be subject to disciplinary action which could include: Dismissal from employment, dismissal from school, legal action, permanent dismissal from the organization.

18  Promote awareness about harassment  A FUTURE COLLEGE PROJECT - Start a campaign on your campus about harassment prevention  Be an advocate for anti-harassment  Speak up when you need to  Become an investigator ….  Check your college for Title IX training sessions
