2 What do we need to know and why do we need to be careful? Copyrighting in the Classroom

3 Showing a movie in class for fun. Playing a taped television broadcast that was recorded last year. Adding music to your class’ webpage without permission. Enhancing your class’ website by using images found on a copyrighted website. Did you know it was this easy to violate copyright laws? COPYRIGHT: WHY WE NEED TO BE CAREFUL

4 The penalty of copyright infringement could be a civil lawsuit in federal district court. In severe cases of willful infringement for profit, the U.S. Attorney may initiate a criminal investigation. Penalty of Copyright Infringement COPYRIGHT: WHY WE NEED TO BE CAREFUL

5 Fair use is the copying of copyrighted material done for a limited purpose. Such uses can be done without permission from the copyright owner. Fair use effects scholars, researchers, and others who would like to use copyrighted material to achieve their purpose whether it be to comment, criticize, or make a parody. 6 1. The purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes 2. The nature of the copyrighted work 3. The amount and substantiality of the portion used in relation to the copyrighted work as a whole 4. 7 Teachers may copy articles to hand out in class, but it can not exceed one copy per student and a notice of copyright must be included. Teachers may make one copy of: Chapter from a book. An article. Short story, poem, or essay. Chart graph, diagram, or drawing. Cartoon or picture from a book. Periodical or newspaper. In the Classroom using Texts COPYRIGHT: WHY WE NEED TO BE CAREFUL

8 Teachers may NOT photocopy: Workbooks. Texts. Standardized tests. Or other materials created for educational use. In the Classroom using Texts COPYRIGHT: WHY WE NEED TO BE CAREFUL

9 A teacher can make copies of excerpts of sheet music as long as it is not 10% of the whole work. A teacher can only make one copy per student. A teacher may NOT copy sheet music or recorded music for performance or class compilations. A teacher can NOT copy consumable materials. 10 For entertainment purposes: you need to clearance or license for its performance. For “face-to-face” teaching activities: allowed, no permission needed as long as the copy is lawful. In the Classroom using Film COPYRIGHT: WHY WE NEED TO BE CAREFUL

11 Television programs can be recorded and used for instructional purposes within 10 days. After the 10 days, the recording can be used for teacher evaluation purposes only. If the teacher wants to add it to the curriculum, permission must be obtained from the copyright owner. If it is not chosen, it must be destroyed within 45 days. 12 Multimedia can only be used in the classroom if it is for educational purposes like: Face-to-face instruction Directed self-study Remote instruction The material may be used for up to 2 years, then it must be destroyed. What to Consider When Using Multimedia in the Classroom COPYRIGHT: WHY WE NEED TO BE CAREFUL

13 You should assume that items are copyrighted. Just because it say it is in a public domain that does not mean it actually is. The author could have placed restrictions on the use and distribution of the program. Many items on the internet may not seem to be copyrighted material when they actually are. Be aware that others can view and copy material from your website. Making Your Classroom’s Website COPYRIGHT: WHY WE NEED TO BE CAREFUL

14 Obtain permission from the last known copyright owner. If they agree, you may have to pay royalties. Teachers, however, are protected under Educated Fair Use guidelines that are recognized by the copyright office.
