3 Supreme Court  AAA  1936-US v. Butler  it was illegal to levy a tax on one group (the processors) in order to pay it to another (the farmers)  1938-redesigned without processor tax  NIRA  1935-Schecter Poultry “ Sick Chicken Case ”  Ruling that it delegated too much power from the legislative to the executive branch and regulated more than interstate trade.

4 FDR ’ s Response  Court Packing Scheme  FDR suggested that advanced age (rather than conservative ideology) was hampering work of SC- FDR proposed increasing the numbers of justices to a maximum of 15 by adding 1 justice for everyone over 70 who had served more than 10 years.

7 Why did the New Deal end?  Opponents could now attack him  The recession of 1937  Conservatives in Congress began to seriously oppose FDR ’ s programs—the 40 hour week & minimum wage (40 cents an hour) increased alienation.  Mid-term 1938 Elections- Republicans narrowed the Democratic majority in Congress.  Bipartisan coalition (Progressive Republicans and Conservative Democrats) formed an alliance that thwarted any new reform initiatives and began to cut expenditures for New Deal Recovery Programs  World War II  Conservative tendencies of Americans  Sit down strikes  caused middle class Americans to fear for the safety of private property.

9 Legacy  Election of 1936  encouraged FDR to pass several liberal programs in order to “ steal his opponents thunder. ” It made the Democratic party the country ’ s majority party.  This election created the New Deal Democratic political coalition that kept Democrats in power until the 1960s: urban ethnic groups, northern blacks, union members, small farmers, and Southern whites.  The New Deal greatly increased the power of the presidency and the national government. For the first time the federal government became seriously involved in social and economic justice.
