7 ACCESS COPYRIGHT’S LICENSING SOLUTIONS COMPREHENSIVE PRINT LICENCE (continued) Coverage is extensive and for handouts in class, reserve copying or other day-to-day uses. Includes: –10% of a publication or a whole chapter, provided it is less than 20% of the book –An entire essay, poem, play, article, or short story from a periodical containing other works –An article from a newspaper, magazine or journal –Entry from a reference work (encyclopedia) –Reproduction of an artistic work from a book or periodical

8 ACCESS COPYRIGHT’S LICENSING SOLUTIONS COMPREHENSIVE PRINT LICENCE (continued) What is a coursepack? A customizable and cost effective solution for students requiring copies of published works from a variety of sources. Groupings of copied materials are bound together in one convenient package. Coursepacks can be the primary resource for a course of study or can supplement other primary resources.

9 ACCESS COPYRIGHT’S LICENSING SOLUTIONS COMPREHENSIVE PRINT LICENCE (continued) Copying allowances for coursepacks are as follows: 15% of a publication or an entire essay, poem, play, article or short story, whichever is greater An entire single item of print music from a book or periodical issue containing other kinds of work An entire chapter, provided it is 20% or less of a book An entire reproduction of an artistic work from a book or periodical Textbooks have special limits: Maximum of 5% or a whole chapter 2 author-publisher pair in 5-year span 50% of coursepacks may be from textbooks

10 ACCESS COPYRIGHT’S LICENSING SOLUTIONS WORKS NOT COVERED UNDER LICENCE INCLUDE Those on the Exclusions List Unpublished works Originals of artistic works Advertisements and Letters to the Editor Newsletters Business case studies Crown or provincial publications (except Quebec) Works for which the Licensee has first sought permissions directly from the copyright owner Instruction Manuals Print music published for use by choirs or bands, etc. Works published in countries with which Access Copyright does not have a reciprocal agreement Reproducables and consumables

11 ACCESS COPYRIGHT’S LICENSING SOLUTIONS PAY-PER-USE LICENCE Permission for one-time or infrequent copying or copying not covered under a comprehensive licence Requires permission in advance of copying Digital licences obtained through pay-per-use licence process –digital to digital format –digital to print –print to digital Digital licence fees are calculated on a per-page, per-user basis or can apply the specific rate set by the copyright owner

13 ACCESS COPYRIGHT’S LICENSING SOLUTIONS OTHER WAYS YOU HAVE PERMISSION Fair dealing: Fair dealing allows some copying in certain circumstances, specifically for research, private study, news reporting, review or criticism. There is a two part test for fair dealing. It must be for one of the purposes stated above and it must be fair. You can get more information about fair dealing by visiting the Canadian Intellectual Property Office's (CIPO) website at www.cipo.gc.ca.www.cipo.gc.ca The Public Domain: When copyright in a work expires, generally in Canada after the creator has been dead for 50 years, the work enters the public domain and you are free to use the work in any way you like. You can get more information about the public domain from CIPO or the Project Gutenberg website at www.gutenberg.org.www.gutenberg.org The Creative Commons: The Creative Commons is a relatively new system that allows copyright owners to provide users with varying degrees of access to their works – by giving their advance permission in a creative commons licence.
