4 What does the Consent Decree do? 1.Resolves the findings that RI violated ADA (Olmstead Act) 2.Includes youth with I/DD in transition from secondary schools: “Rhode Island Youth Transition Target Population” “Rhode Island Youth Exit Target Population” 3. Defines certain terms and outcomes TLS Network

5 Phase I: Deadlines “RI Youth Exit Target Population” Exiting Class of: 2013-2014 2014-2015 2015-2016 October 1, 2014 - All individuals in “RI Youth Transition Target Population” will have services & supports described in Section V (A & B) of Consent Decree January 1, 2015 - All individuals in “RI Youth Exit Target Population” will have person- centered planning resulting in a career development plan… Sections V (A) (1&2) and Section V of Consent Decree 8/18/2015

7 ORS Creation of an IDD Supported Employment Unit Created timeline with RIDE and BHDDH to assist schools with referrals to adult services. Developed a referral process for ORS to attend/ provide input to Career Development Teams. (letter to Sped Directors) Lead agency in developing Miriam Project Search in Providence to offer work experiences to students with IDD in their last year of high school Developing a pilot project with Cumberland High School and NRI collaborative to offer a summer work experience to students in ESY. Offering four group benefits counseling information meetings around the state for students receiving SSI/SSDI to discuss work incentives. 8/18/2015

8 Sherlock Center Demonstration Project Family Employment Awareness Training (FEAT) Self-Determination Training Discovery- Employment Experience 8/18/2015 CEA Professional development opportunities to 12 schools and districts addressing employment for youth with IDD and the consent decree

10 BHDDH Division of Developmental Disabilities Eligibility Criteria To be eligible for supports funded through the Division of Developmental Disabilities individuals must meet the following definition of developmental disability, as stated in RI State Law: "The term 'developmental disability' means a severe, chronic disability of a person which: attributable to a mental or physical impairment of combination of mental and physical impairments; is manifested before the person attains age twenty-two (22); is likely to continue indefinitely; results in substantial functional limitations in three or more of the following areas of major life activity: – personal care – communication – mobility – learning – self-direction – capacity for independent living – economic self-sufficiency; and, reflects the person's need for a combination and sequence of special, interdisciplinary, or generic care, treatment, or other services which are life-long or extended duration and are individually planned and coordinated." 8/18/2015 Rhode Island General Laws § 40.1-21-4.3(5)

11 Things to continue Read the Consent Decree – Parents may be aware of it and refer to it in IEP and Transition meetings Dialog with school & district – How your practices, forms and procedures meet the expectations of the Consent Decree – Consistent documentation of evidence your district is complying with the CD Paradigm – Everyone can and is expected to enter supported employment – It is in your best interest to document instances where the steps toward employment are altered (i.e. parent refuses, adult agency will not participate, etc.) 5/23/2014
