2 Facts About Trafficking In The United States and Kansas O In order to prove an adult case of human trafficking, one of the following must be proven – force, fraud, or coercion O In a minor (under 18) case, due to age of the victim, they are automatically a victim of human trafficking O 100,000 – 300,000 are trafficked in the United States annually O The average age for entering trafficking is 11-13 years of age for boys and 12-14 years of age for girls O The three types of trafficking are sexual exploitation, labor, and organ

3 History 101 O 2000 – Trafficking Victims Protection Act came into effect (Federal Level) O Trafficking Victims Protection Act – the first federal law to address trafficking and persons (three pronged approach – protection, prevention, and prosecution). Reauthorized thru Trafficking Victims Protection Act in 2003, 2005, 2008 O 2005 - Kansas SB 72 (K.S.A. §21-3707) creates the crime of trafficking as a severity level 2, person felony and aggravated trafficking as a severity level 1, person felony.

4 History 101 (Continued) O Kansas started looking at creating state legislation once the Victims of Trafficking and Violence Act was passed in 2000. O In 2007, State of Kansas v. Marlin Williams in which the defendant (Williams) took a 15- year-old girl from Wichita, Kansas to Dallas, Texas and sexually exploited her. Williams was convicted and sentenced to 20 ½ years.

5 History 101 (Continued) O January 2010 – Kansas establishes Human Trafficking Advisory Board O 2010 - Kansas Senate Bill 434 changes criminal procedures for a number of crimes; human trafficking is one of them. O 2010 - Kansas Senate Bill 586 makes aggravated human trafficking a severity level 1, person felony.

6 History 101 (Continued) O Introduced on January 24, 2011, passed in Senate on Feb. 22, 2011, and died in House on June 1, 2012 – House Sub for Senate Bill 46 covers “an act concerning crimes, punishment, and criminal procedure; relating to human trafficking; human trafficking advisory board; establishing the human trafficking victim assistance fund; creating the crime of commercial sexual exploitation of a child; relating to selling sexual relations; promoting the sale of sexual relations; buying sexual relations; amendments.” O 2011 - Kansas House Bill 2010 relates to “civil procedure; relates to covered offenses and conduct giving rise to forfeiture to include theft, criminal discharge of a firearm, gambling, Medicaid fraud, dog and cock fighting or dog and cock fighting paraphernalia, prostitution, human trafficking, worthless checks, forgery, mistreatment of a dependent adult, IDENTITY THEFT or identity fraud, and criminal use of a financial card.” O 2011 – Senate Bill 37 amends Kansas offender registration act

7 History 101 (Continued) O 2013 – Kansas State Legislation recognized Human Trafficking Advisory Board as the official human trafficking board O January 18, 2013 – Senate Substitute House Bill 2034 was introduced O Senate Substitute House Bill 2034 focus is “an act concerning crimes, punishment, and criminal procedure; relating to human trafficking; human trafficking advisory board; establishing the human trafficking victim assistance fund; creating the crime of commercial sexual exploitation of a child; relating to selling sexual relations, promoting sexual relations, buying sexual relations; children in need of care; safe secure facilities”; amendments O January 22, 2013 - Senate 61 was introduced but NOT passed O March 22, 2013 – Senate Substitute House Bill 2034 was recommended to be passed O April 22, 2013 – Senate Substitute House Bill 2034 was passed

8 History 101 (Continued) O January 24, 2014 – House Bill 2501 was introduced O House Bill 2501, “an act concerning human trafficking and related crimes; relating to court records and reporting; fines; diversion; buying sexual relations; staff secure facility requirements;” amendment. O Introduced February 14, 2014 and died in the House on May 20, 2014 – House Bill 2710 “makes certain sex crimes, where the offender is over 18 and the victim is under 14, which currently have a mandatory minimum sentence of 25 years could be increased to 35 if aggravating circumstances found.” O April 8, 2014 – House Bill 2501 was signed by Governor Brownback
