1 XML Activities within the Canadian Intellectual Property Office (CIPO) Prepared for WIPO CWS Derek Spero DBA/Solutions Architect

2 IP Systems at CIPO CIPO currently has systems in place for the administration of these 4 IP types: PatentsTrademarksIndustrial DesignsCopyright Over 2,140,000 Patents. 474,458 are PCT National entries. Growth of 8,000+ Direct filings/yr. Growth of 36,000+ PCT National entries/yr. 2% of direct filings are received electronically. As a PCT/RO, CIPO has received over 20,000 filings with growth of 2,500/yr. Over 1,290,000 Trademarks. Growth of 50,000/yr. 93% of filings are received electronically. (These statistics are from May 2013) Over 150,000 Industrial Designs. Growth of 5,000/yr. 20% are received electronically. Over 120,000 Copyrights. Growth of 3,000+ /yr. 90% of filings are received electronically. NOTE : CIPO also administers Integrated Circuit Topology which is a manual process due to low volumes.

3 Current use of XML standards at CIPO PatentsTrademarksIndustrial DesignsCopyright An ST.36 repository is used to index our search engine. This same repository is used to disseminate our data to WIPO and EPO. PatentScope data is received in ST.36 format and stored in our legacy database. PCT-Safe input and ROWASP output are in ST.36 format. Ready to store Biological sequences in XML format. None received thus far. Trademark data which is sent to WIPO is converted to ST.66 at WIPO. ST.86 dissemination completed in 2012. WIPO began to accept these weekly feeds February 2013. No XML activity at this time.

4 Activities currently underway for use of ST.96 at CIPO 1. CIPO has developed a process to produce an ST.96 repository of Trademark data and to disseminate this data. This process is being tested. 2. A subsequent project is expected to make use of the XML repository to present the ST.96 data to e-commerce users for the purpose of updates via the internet. 5 Future activities for use of ST.96 at CIPO CIPO is committed to being capable of sending and receiving IP data in ST.96 format for all product lines. Which product line goes first and the timeline of these initiatives will depend on CIPO’s priorities as well as the priorities of the IP community.
