2 2010 Revisions to the ADA

3 2010 Revised ADA Title II –State and Local Government Services Title III –Public Accommodations and Commercial Facilities

4 Important Dates Revisions Published- September 15, 2010 General Effective Date- March 15, 2011 –As of this date, policies must be compliant with new requirements

5 As of March 15, 2012…. Public entities must comply with the 2010 Standards to achieve program access and for all new construction and alterations

6 Also…. Must consider supplemental requirements such as swimming pools, play areas, and fishing piers No Safe Harbor

7 Existing Facilities If in compliance with 1991 Standards or UFAS and not being altered, not required to make changes Does not apply to elements in existing facilities that were not subject to specific requirements in the 1991 Standards

8 Noncomplying Facilities After March 15, 2012, Title III covered entities must bring noncomplying facilities into compliance with the 2010 Standards NOTE: Requirements for existing pools and spas was extended until January 31, 2013.

9 Communication, Auxiliary Aids, and Services General Rule: Title II “A public entity shall take appropriate steps to ensure that communications with applicants, participants, members of the public, and companions with disabilities are as effective as communications with others”

11 OHIO BUILDING CODE NEXUS IS Ohio Building Code Accessible Design Requirements

12 Ohio first adopted accessibility requirements in 1993 to coordinate with FHAA and ADA OHIO BUILDING DEPARMENTS HAVE NO RESPONSIBILITY TO ENFORCE FEDERAL LAWS! OBC rules have mirrored the federal requirements and OBC requirements are enforced by building departments

13 OBC Changes in 2012 Ohio, in conjunction with ICC and Federal Govt. Representatives, developed revisions to accessibility requirements to streamline compliance. Series of modifications in Chapter 11 ANSI Standard now in line with new ADAAG requirements

14 As of March 15, 2012…. The accessibility provisions in the OBC coordinate with new Federal accessibility rules and the 2010 ADA Standards Buildings and facilities must be designed in accordance with (2012) OBC Chapter 11 and the ICC/ANSI A117.1-2009 version

15 No more confusion Now refer to OBC Chapter 11 and ICC/ANSI A117.1 for all accessibility provisions. OBC Chapter 35 for existing building has also been revised. No longer references ADAAG- only ICC/ANSI A117.1 for accessibility requirements.
