3 Tobacco Regulation By the FDA  FDA- Food and Drug Administration  FDA provisions signed into law by the U.S Congress and President Obama on June 22, 2009  The Family Smoking Prevention and Tobacco Control Act

4 What Does this Mean?  Regulation  Bans candy and fruit-flavored cigarettes  Bans misleading terms  Warning labels  Necessary restrictions to prevent marketing and sales to kids

5 June 22, 2009  No reduced risk claims Products: cigarettes and smokeless No claims of reduced risk unless given permission by the FDA.

6 June 22, 2009  Federal cigarettes labeling act States have the power to place restrictions on the time and place to advertise tobacco products in order to promote public health.

7 Even though the FDA is now regulating tobacco, companies are not allowed to mislead consumers into thinking that it is approved, “safe”, or less harmful because it is regulated by the FDA. June 22, 2009  Illegal to make statements that mislead consumers to believe the tobacco is approved or endorsed by FDA

8 July 22, 2009 Light, Low, Mild and similar descriptions are banned in describing any new cigarette or smokeless product or brand.

9 September 28, 2009 All flavors other than tobacco and menthol are banned from cigarettes including their wrappers, filters, ect.

10 December 19, 2009  Companies must provide FDA list of ingredients and additives

11 June 22, 2010 Prohibits the sale of cigarettes and smokeless tobacco to people under the age of 18.

12 June 22, 2010  Larger smokeless tobacco warning labels required

13 June 22, 2010  Black and white ads  Audio advertising

14 June 22, 2010  FDA Rule: No branded product tie-ins, such as T-shirts, purchases.

15 June 22, 2010  No free samples

16 June 22, 2010  No branded sponsorships

17 June 22, 2010  Outdoor advertising

18 October 1, 2010 FDA has established the Tobacco Product Scientific Advisory Committee. Within 12 months: Must issue report on menthol cigarettes’ impact on public health Within 24 months: must issue reports on dissolvable tobacco

21 October 1, 2012  FDA must issue regulations to prevent the sale of tobacco products to youth via internet, mail order or other non face to face sales.
