2 DFO Fish Habitat Management n Administers the Fish Habitat Protection Provisions of the Fisheries Act n Administers provisions of the Species at Risk Act as they pertain to Aquatic Species n Conducts Environmental Assessments under the Canadian Environmental Assessment Act n Participates in Territorial Environmental Assessments and Regulatory Reviews by providing specialist/expert advice

3 The Fisheries Act n Used to manage and protect Canada's fisheries resources n Applies to all fishing zones, territorial seas and inland waters n Binding on federal, provincial, and territorial governments

4 The Fisheries Act n Defines “Fish” as including: – “… fish; shellfish, crustaceans, marine animals and any parts of …” – “…eggs, sperm, spawn, larvae, spat and juvenile stages…”

5 The Fisheries Act “spawning grounds and nursery, rearing, food supply migration and any other areas on which fish depend directly or indirectly in order to carry out their life processes” Defines Fish Habitat as:Defines Fish Habitat as:

7 The Fisheries Act Habitat Protection Provisions n Section 35(1) –Prohibits harmful alteration, disruption or destruction of fish habitat (HADD) n Section 35(2) –Provides Minister of Fisheries and Oceans with ability to Authorize (HADD)

8 DFO Areas of Interest for the Type A Water Licence Application n Potential draw down of Nipissar Lake (HADD) n Water intake (HADD, entrainment/impingement)

9 DFO Request for Additional Information n A detailed assessment of the proposed volume of water to be withdrawn from Nipissar Lake against total annual recharge and the potential ramifications of draw down. n A detailed description of the proposed water intake.

11 Next Steps Forward: Water Intake n The type of existing intake screen is unknown. As it is a DFO requirement to have a screen on the intake, the GN will provide this information to DFO for review when available n The GN indicated that the DFO Fish Screen Guidelines will be used to determine the most appropriate screen for the intake Information based on March 25, 2010 letter to L. 12 Next Steps Forward: Water Supply from Nipissar Lake n The Government of Nunavut has agreed to undertake lake studies through 2010 to assess current and future impacts to lake levels resulting from withdrawals and the potential impacts on the aquatic environment Information based on March 25, 2010 letter to L.
