2 What is it?  The Bill of Rights is the first 10 amendments to our Constitution  Amend – to change or add

3 1 st Amendment  Freedom of religion (practice any religion)  Freedom to assemble (meet or gather)  Freedom of the press (publish newspapers, TV and Internet posts)  and Petition (address the government)  Freedom of speech (speak freely)  RAPPS

4 Limitations on Speech  “Clear and Present Danger” Clause Cannot publish any material that endangers our national security. Cannot pose any threat to the safety concerns of the people of the United States. ○ EX – Yelling “bomb” on an airplane

5 Limitations on Speech  Defamation – knowingly making false statements about a persons reputation, thus giving them a “negative image” to the public.

6 2 nd Amendment  The right to bear arms (having and carrying a weapon)

7 3 rd Amendment  The right to not have soldiers quartered in your home.

8 4 th Amendment  Proper search and seizure procedures  Note: Warrant and probable cause needed.

9 5 th Amendment  1. Cannot be tried twice for the same offense (double jeopardy)  2. Do not have to testify against yourself in court.

10 6 th Amendment  1. Speedy, public trial  2. Jury decides the case  3. Right to a lawyer

11 7 th Amendment  Right to a jury in a civil lawsuit (one where money is at stake) $20 or more  A civil trial differs from a criminal trial. A civil trial is when one citizen sues another citizen.

12 8 th Amendment  1. No excessive bail/fines  2. No cruel and unusual punishment. (Electric Chair for stealing gum)

13 9 th Amendment  You have more rights than what are listed in the Constitution.  EX – Just because the Constitution doesn’t say you can drive in the rain, doesn’t mean you can’t drive in the rain.

14 10 th Amendment  States have their own rights that are not given to the federal government.  In other words, Laws that aren’t said in the Constitution, are in the hands of the States.  Examples: Same-sex marriage, drug laws (marijuana), etc.
