1 AQUACULTURE PROPOSED LISTINGS ITO EIA REGULATIONS

2 Rationale for listing of aquaculture facilities Aquaculture facilities utilising either exotic or indigenous species above a certain scale can have significant negative impacts on the environment in terms of water, soil and air polution etc. However, if the facility is designed correctly, managed sustainably and in the correct location aquaculture can be beneficial in terms of food security, job creation etc. Therefore, all aquaculture facilities (above lower threshold) will now require basic assessment (BA) (sea -based as well as "land" based). For species exotic to the area: These require either a BA or Scoping & Environmental Impact Report (S&EIR) depending on thresholds. The regulation comprise of 3 listing notices Listing notice 1 – where Basic Assessment (BA) applies Listing notice 2 – where a more comprehensive Scoping & Environmental Impact Report (S&EIR) applies; and Listing Notice 3 – treatment of small developments in certain environmentally sensitive geographic areas. (If a basic assessment (listing notice 1) threshold is not met (small developments) this will still require BA if it is situated within specified geographical areas as per Listing Notice 3). The specific provisions are listed below

3 LISTING NOTICE 1 (Basic assessment for smaller scale facilities) The development or development and related operation of facilities, infrastructure or structures, including associated structures and infrastructure, for aquaculture of— (i)finfish, crustaceans, reptiles or amphibians, exotic to the area where such facility, infrastructure or structures will have a production output exceeding 20 000 kg but less than 200 000 kg per annum (wet weight); (ii)molluscs and echinoderms, exotic to the area where such facility, infrastructure or structures will have a production output exceeding 30 000 kg but not exceeding 150 000 kg per annum (wet weight); or (iii)aquatic plants, exotic to the area where such facility, infrastructure or structures will have a production output exceeding 60 000 kg but not exceeding 200 000 kg per annum (wet weight); (iv)finfish, crustaceans, reptiles or amphibians, indigenous to the area where such facility, infrastructure or structures will have a production output exceeding 20 000 kg per annum (wet weight); (v)molluscs and echinoderms, indigenous to the area where such facility, infrastructure or structures will have a production output exceeding 30 000 kg per annum (wet weight); or (vi)aquatic plants, indigenous to the area where such facility, infrastructure or structures will have a production output exceeding 60 000 kg per annum (wet weight); excluding where the development of facilities, infrastructure or structures is for purposes of sea- based cage culture in which case activity 7 in this Notice will apply

4 LISTING NOTICE 1 (Basic assessment for smaller scale facilities) Activity 7 - The development or development and related operation of facilities, infrastructure or structures, including associated structures and infrastructure, for aquaculture of – (i)sea-based cage culture of finfish, crustaceans, reptiles, amphibians, molluscs, echinoderms and aquatic plants, exotic to the area where the facility, infrastructure or structures will have a production output exceeding 50 000 kg but not exceeding 100 000 kg per annum (wet weight); or (ii)sea-based cage culture of finfish, crustaceans, reptiles, amphibians, molluscs, echinoderms and aquatic plants, indigenous to the area where the facility, infrastructure or structures will have a production output exceeding 50 000 kg per annum (wet weight).

5 LISTING NOTICE 1 (Basic assessment for smaller scale facilities) The expansion or expansion and related operation of facilities, infrastructure or structures for aquaculture of— (i)finfish, crustaceans, reptiles or amphibians, where the production output of such facility, infrastructure or structures will be increased by 20 000 kg (wet weight) or more; (ii)molluscs and echinoderms where the production output of such facility, infrastructure or structures will be increased by 30 000 (wet weight) or more; or aquatic plants where the production output of such facility, infrastructure or structures will be increased by 60 000 kg (wet weight) or more. The expansion or expansion and related operation of facilities, infrastructure or structures for aquaculture of sea-based cage culture of finfish, crustaceans, reptiles, amphibians, molluscs, echinoderms and aquatic plants where the production output of such facility, infrastructure or structures will be increased by 50 000 kg (wet weight) or more.

6 LISTING NOTICE 2 (Scoping & Environmental Impact Report for larger scale facilities) The development or development and related operation of facilities, infrastructure or structures, including associated structures and infrastructure, for aquaculture of─ (i)finfish, crustaceans, reptiles or amphibians where the facility, infrastructure or structures will have a production output of 200 000 or more kg per annum (live round weight); (ii)molluscs and echinoderms where the facility, infrastructure or structures will have a production output of 150000 or more kg per annum (live round weight); (iii)aquatic plants where the facility, infrastructure or structures will have a production output of 200 000 or more kg per annum (live round weight); excluding where the development of facilities, infrastructure or structures is: (a)for species indigenous to the area in which case activity 6(iv), (v) or (vi) in Listing Notice 1 of 2014 will apply; or (b)for purposes of sea-based cage culture in which case activity 14 in this Notice will apply.

7 LISTING NOTICE 2 (S&EIR for larger scale facilities cont) The development or development and related operation of facilities, infrastructure or structures, including associated structures and infrastructure, for aquaculture of sea-based cage culture of finfish, crustaceans, reptiles, amphibians, molluscs, echinoderms and aquatic plants where the facility, infrastructure or structures will have a production output of 100 000 or more kg per annum (live round weight); excluding where the development of facilities, infrastructure or structures is for species indigenous to the area in which case activity 7(ii) in Listing Notice 1 of 2014 will apply.

8 LISTING NOTICE 3 (Basic assessment below Listing Notice 1 thresholds but in specific geographic areas) The development or development and related operation of facilities, infrastructure or structures, including associated structures and infrastructure, of any size for any form of aquaculture. (a)In an estuary; or (b)In a Protected Area identified in the NEMPAA; (c)Areas on the watercourse side of the development setback line or within 100 metres from the edge of a watercourse where no such setback line has been determined.
