COACHES MEETING POWERPOINT 1

Dear Coaches, The following is a presentation which includes information that I am required to communicate and I hope you can use as a resource for yourself and your programs. I was a coach and so I know the challenges that you go through on a daily basis, not only during the season but in the off-season as well. I am honored to be the Athletic Director at such a fine school as Venice and to be associated with such a great group of coaches. I really believe we have an outstanding coaching staff at Venice and I am proud to be a part of it. Please let me know if there is anything I can do to support you. Rich

B UD W ILKINSON LEGENDARY former Oklahoma football coach Bud Wilkinson once said; “The use of profanity shows two things: a limited vocabulary and a lack of imagination.”

LEGAL ISSUES 63

NEGLIGENCE 64

NEGLIGENCE IS THE MOST COMMON TORT SUIT FILED AGAINST COACHES 65

NEGLIGENCE… occurs when a coach fails to act as a reasonable and prudent person would act in a similar situation 66

An important element in determining negligence is failing to anticipate and eliminate unreasonable risks of injuries that a reasonably prudent person would have anticipated and eliminated. 67

THIS HAD BEEN TERMED THE DOCTRINE OF FORESEEABILITY 68

THREE GENERAL AREAS 1.Sound planningSound planning 1.Inherent risks (proper instruction); adequate supervision, matching and equating opponents, evaluating athletes' disabilities (proper supervision)Inherent risks (proper instruction); adequate supervision, matching and equating opponents, evaluating athletes' disabilities (proper supervision) 1.Safe playing environment (proper maintenance), and emergency first-aid proceduresSafe playing environment (proper maintenance), and emergency first-aid procedures

To determine negligence in the case of a coach, FOUR basic questions will be asked: 70

1. Do you owe the players a duty? 2. Was the duty breached? 3. Was your breach of duty responsible for the player's injuries? 4. What is the extent of the actual injury or damage? 71

For negligence to be established, all four of these questions must be answered in the affirmative. 72

14 DUTIES REGARDING LIABILITY PROPER PLANNING QUALIFIED SUPERVISION ASSESSED READINESS OF ATHLETES SAFE ENVIRONMENT AND CONDITIONS APPROPRIATE AND SAFE EQUIPMENT PROPER INSTRUCTION PROPER MATCHING OF ATHLETES PROPER CONDITIONING SPORT-SPECIFIC WARM UP VERIFY INSURANCE COVERAGE PROPER EMERGENCY CARE EMERGENCY RESPONSE PLAN PROPER TRANSPORTATION SELECTION, TRAINING AND SUPERVISION OF COACHES
