12 Empowerment of National Shipping Industry Empowerment of National Shipping Industry and Strengthening National Maritime / Shipbuilding Industry are mandated to be conducted by Government Strengthening of National Maritime / Shipbuilding Industry a.Providing Financial and fiscal/ taxation facility; b.Facilitating long-term contract partnership between cargo owner and ship owner; and c. Providing guarantee on the availability of bunker oil for sea transportation. a.Establishment of integrated maritime / shipbuilding industry zone; b.Development of design center, research and development of national maritime / shipbuilding industry; c.Development of ship material/ equipment and standarization; d.Development of ship material and equipment industry; e.Providing incentive to national shipping companies, which are building and/ or repairing repairing ships in domestic shipyard and/ or purchasing ship from foreign country; f. Building ships in domestic shipyard if the procurement is financed by national/ local budget; g. Building ships which is financed by foreign loan with local content as much as possible; and, h.Maintainance and repairement of ships in domestic shipyard if financed by national/ local budget. 14 HARBOUR MASTER DUTIES OF HARBOUR MASTER a.to oversee compliance to seaworthiness, safety and orderliness at harbor; b.to ensure orderliness of traffics in harbor waters and shipping lanes; c.to oversee transshipment activities in harbor waters; d.to oversee performance of underwater and salvage operation; e.to oversee towage activities; f.to oversee Pilotage activities g.to oversee handling of hazardous and toxic materials and waste ; h.to oversee fuel refilling activities; i.to ensure orderliness in passenger embarkation and disembarkation activities; j.to oversee dredging and reclamation activities; k.to oversee harbor facility development activities; l.to execute search and rescue operation; m.to lead the activities of preventing and addressing contamination and fire fighting at harbors; and n.to oversee implementation of marine environmental protection activities. FUNCTIONS OF HARBOUR MASTER : EXECUTES THE FUNCTION OF SAFETY AND SECURITY, INCLUDING TO SUPERVISE AND ENFORCE LAW ON SEA TRANSPORTATION, ON HARBORS AND PROTECTION OF MARINE ENVIRONMENT AT PORTS DGST - MOT 13 Implementation of Law No. 17 / 2008 on Shipping in Supporting Sea Transportation and Sea Port Development in Indonesia

15 I In performing its functions and duties, Harbour Master will carry out as follows : a.coordination of all the goverment activities at the harbor; b.verify and keeping the letters, documents and ship manifests; c.issuance of approval for ship activities at the harbor; d.ships inspection; e.issueance of Port Clearance; f.investigation of accidents involving ship (s); g.detentaion of ships based on court order; and h.legalisation of ships crew official documents; HARBOUR MASTER DGST - MOT 14 Implementation of Law No. 17 / 2008 on Shipping in Supporting Sea Transportation and Sea Port Development in Indonesia

16 FUNCTIONS OF PORT AUTHORITY : GUIDING, CONTROLLING AND SUPERVISING PORT ACTIVITIES IN COMMERCIAL PORTS PORT AUTHORITY DUTIES OF PORT AUTHORITY: a.to a.to provide land and water territories for the ports; b.to provide and maintain wave breakers/ seawall, port basin, sea lanes and road network; c.to provide and provide Maritime Navigation Aids; d.to ensure safety and security in the ports; e.to ensure and maintain sustainable environment at the ports; f.to compile the Port Masterplans, Port Working Area and Environmental Necessity Area; g.to propose tariffs to be approved by the Minister for the use of the water and/or land territories as well as port facilities provided by the Government, and port services catered by the Port Authorities according to the provisions of laws and regulations; and h.to ensure smooth traffic of goods. 17 PORT AUTHORITY In order to carry out the duties and responsibilities, the Port Authorities shall be authorized to: a.to regulate and oversee the use of land and water of the ports; b.to supervise the use of Port Working and Environmental Necessity Area; c.to organized the incoming and outgoing vessel’s traffic with the assistance of pilot; and d. to approved the performance standard of port service operation. 18 F FUNCTIONS: GUIDING, CONTROLLING AND SUPERVISING THE ACTIVITIES IN NON COMMERCIAL PORTS PORT OPERATION UNIT DUTIES: 1. To provide and maintain the break water, port basin, and traffic line; 2. To provide and maintain the Marine Navigational Aids ; 3. To ensure safety and security in the ports; 4. To ensure and maintain sustainable environment protection in the ports; 5. To compile the Port Masterplan Special Port Bounded Area and Special Port Designated for Working Area; 6. To endure smooth traffic of goods; and 7. To provide port facilities. 19 FUNCTIONS: TO CARRY OUT THE ACTIVITY OF PORT MANAGEMENT SERVICE, CONSISTING OF PORT MAIN SERVICES AND AUXILIARY SERVICES. PORT BUSINESS ENTITIES IN PERFORMING PROVISION OF PORT SERVICES ACTIVITY, PORT BUSINESS ENTITY HAS SOME OBLIGATIONS AS FOLLOWS : DGST - MOT 18 Implementation of Law No. 17 / 2008 on Shipping in Supporting Sea Transportation and Sea Port Development in Indonesia a. To provide port facilities and maintain their feasibility; b. To provide services to port users according to the service standards as determined by the Government; c. To maintain the safety, security and obedience in port facilities; d. To participate in maintaining the safety, security and obidience pertaining to sea transportation; e. To maintain sustainable environment protection; f. To confirm with the obligations as stated in the concession agreements; and g. To confirm with the provisions of national and international laws and regulations.

20 Providing services to the vessels, passengers and cargoes including : a. providing mooring services; b. refueling and providing clean water; c. embarking and disembarking services for passengers and/or vehicles; d. loading and unloading of containers; e. warehousing and piling of cargoes, rental of loading and unloading equipment and port equipment; f. providing container terminal, liquid bulk, dry bulk, and Ro-Ro services; g. providing loading and unloading services; h. providing cargo distribution and consolidation; and/or i. providing tugging services. 23 Article 40 dan 41 (Tanggung Jawab Pengangkut/ Carrier’s Liability) Article 41 verse (1) Tanggung jawab sebagaimana dimaksud dalam pasal 40 dapat ditimbulkan sebagai akibat pengoperasian kapal, berupa:- a.Kematian atau lukanya penumpang yang diangkut. b.Musnah, hilang, atau rusaknya barang yang diangkut. c.Keterlambatan angkutan penumpang dan/atau barang yang diangkut. d.Kerugian pihak ketiga. Marine Insurance PROTECTION AND INDEMNITY (P&I) for SHIP OWNER and/ or SHIP OPERATOR Article 41 verse (3) Perusahaan angkutan di perairan wajib mengasuransikan tanggung jawabnya sebagaimana dimaksud pada ayat (1) dan melaksanakan asuransi perlindungan dasar penumpang umum sesuai dengan ketentuan peraturan perundang- undangan. 24 Article 50, 51, 52, 53, 54, dan 55 ( Multimodal Transportation) Article 51 verse (2) Badan usaha sebagaimana dimaksud pada ayat (1) bertanggung jawab (liability) terhadap barang sejak diterimanya barang sampai diserahkan kepada penerima barang. Article 53 verse (1) Tanggung jawab penyedia jasa angkutan multimoda sebagaimana dimaksud dalam Pasal 51 ayat 2 meliputi kehilangan atau kerusakan yang terjadi pada barang serta keterlambatan penyerahan barang. Article 54 Penyedia jasa angkutan multimoda wajib mengasuransikan tanggung- jawabnya. 25 Article 100 (Tanggung Jawab Ganti Kerugian) Article 100 verse (1) Orang perseorangan WNI dan/atau badan usaha yang melaksanakan kegiatan di pelabuhan bertanggung jawab untuk mengganti kerugian atas setiap kerusakan pada bangunan dan/atau fasilitas pelabuhan yang diakibatkan oleh kegiatannya. Article 100 verse (2) Pemilik dan/atau operator kapal bertanggung jawab untuk mengganti kerugian atas setiap kerusakan pada bangunan dan/atau fasilitas pelabuhan yang diakibatkan oleh kapal. Article 100 verse (3) Untuk menjamin pelaksanaan tanggung jawab atas ganti kerugian sebagaimana dimaksud pada ayat (1) pemilik dan/atau operator kapal yang melaksanakan kegiatan di pelabuhan wajib memberikan jaminan. 26 Article 101 (Tanggung Jawab Ganti Kerugian) Article 101 verse (1) Badan Usaha Pelabuhan bertanggung jawab terhadap kerugian pengguna jasa atau pihak ketiga lainnya karena kesalahan dalam pengoperasian pelabuhan. Article 101 verse (2) Pengguna jasa pelabuhan atau pihak ketiga sebagaimana dimaksud pada ayat (1) berhak mengajukan tuntutan ganti kerugian. 27 Article 151 (Kesejahteraan Awak Kapal dan Kesehatan Penumpang) Article 151 verse (1) Setiap Awak Kapal berhak mendapatkan kesejahteraan yang meliputi:- g) pemeliharaan dan perawatan kesehatan serta pemberian asuransi kecelakaan kerja. 28 Article 203 (Ship Wreck Removal) Article 203 verse (1) Pemilik kapal wajib menyingkirkan kerangka kapal dan/atau muatannya yang mengganggu keselamatan dan keamanan pelayaran paling lama 180 hari kalender sejak kapal tenggelam. Article 203 verse (2) Pemerintah wajib mengangkat, menyingkirkan, atau menghancurkan seluruh atau sebagian dari kerangka kapal dan/atau muatannya atas biaya pemilik apabila dalam batas waktu yang ditetapkan Pemerintah, pemilik tidak melaksanakan tanggung jawab dan kewajibannya sebagaimana dimaksud pada ayat (1). Article 203 verse (5) Untuk menjamin kewajiban sebagaimana dimaksud pada ayat (1) dan ayat (2) pemilik kapal wajib mengasuransikan kapalnya. 29 Article 231 (Prevention and Response of Pollution from Ship Operation) Article 231 verse (1) Pemilik atau operator kapal bertanggung jawab terhadap pencemaran yang bersumber dari kapalnya. Article 231 verse (2) Untuk memenuhi tanggung jawab sebagaimana dimaksud pada ayat (1) pemilik atau operator kapal wajib mengasuransikan tanggung jawabnya. INDONESIAN FLAG-VESSELS SERVING ON INTERNATIONAL TRADE HAVE COMMONLY BEEN COVERED BY P&I SINCE THEY ARE MANDATORY REQUIREMENT BY MAJOR INTERNATIONAL PORTS; 2. MAIN OBSTACLES TO IMPLEMENT P&I FOR INDONESIAN FLAG-VESSELS ARE MAINLY ON THE SEAWORTHINESS REQUIREMENT OF INDONESIAN FLAG-VESSELS AND COST SET BY UNDEWRITER; 3.
