2  A waste is hazardous if it can be harmful to human health and the environment when handled improperly  Determining whether or not a waste qualifies as hazardous is important because only hazardous wastes that meet the criteria above are subject to RCRA regulations

3  Core samples have identified a “Hot Spot”  US Army Core of Engineers have determined “disposal areas” designated for dredging sediment are filling up at a quicker rate than originally anticipated…  EPA Thresholds for land or ocean application are much lower, therefore increasing the probability for a hazardous waste  Once a hazardous finding is determined there are certain requirements you must adhere to  The regulatory agencies that determine how a hazardous waste should be managed are EPA, DOT and TCEQ  PCB’s are regulated under TSCA (Toxic Substances Control Act)  EPA Regulations can be found in 40CFR and DOT regulations are under 49 CFR

4  What is my generator status?  CESQG (Conditionally Exempt Small Quantity Generator) 100 Kilograms or less per month of hazardous waste  SQG Less than 1000 Kilograms per month  LQG More than 1000 Kilograms per month Requirements for each can be found in 40 CFR

5  Analytical Testing/Accurate Waste Determination  90 Day Storage Maximum  RCRA Safe Storage Containers with Drip Pads/Proper Containment to Avoid Release  EPA and State ID #’s  Labeling  Hazardous Waste Contingency Plan  Haz Mat Employee Available 24/7 to respond in the event of an emergency  Compliant with Federal and State Regulations to Ensure Safe and Compliant Transportation and Disposal  Receipt of Manifest within 45 Days

6  Disposal Provider Should:  Help you Determine Characterization  Best Treatment/Disposal Option (i.e. landfill, kilns, stabilization – Incineration should be the last alternative due to cost)  Profiling  Completed Labels and Haz Manifest  Hazardous Waste Carrier (Haz Mat Endorsed)  Scheduling and Ensuring Your Manifest is Returned Within 45 days. Start Calling After 25 days.

7  Hazardous waste must be stored in containers, tanks, containment buildings, drip pads, waste piles, or surface impoundments that comply with the RCRA regulations  The regulatory requirements for these types of storage units are found in 40 CFR Part 26440 CFR Part 264

9  The words “Hazardous Waste” and the Start Accumulation Date should be clearly marked on the container  The DOT label exactly identifies the waste, including name, characteristics and handling requirements
