6 Overview: Showing a video… Face-to-Face Classroom OK! Public performance rights not needed (unless non-teaching related or open to public) Online Instruction Restrictions Apply to both 100% online and to online supplements to f2f (Blackboard, etc.)

7 Overview: Copyright “Copyright is a form of protection provided by the laws of the United States (title 17,U.S.Code) to the authors of ‘original works of authorship,’ including literary, dramatic, musical, artistic, and certain other intellectual works.” Exceptions allow use of copyrighted works: Fair use TEACH Act

8 Fair Use (Title 17, Section 107, US Code) (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work. 12 DMCA: Copying DVDs DVDs frequently protected by CSS and other technological protection measures VHS do not have this problem Breaking TPMS is illegal, even if your use is legal DMCA: Digital Millennium Copyright Act

13 DMCA Exceptions (2010, 2012) Allow: short portions “criticism or comment “ and “educational purposes” Use screen capture software If higher quality is needed, OK to break TPMs for “film studies or other courses requiring close analysis of film and media excerpts” Blu-ray discs not included in these exceptions

Find the video you desire Locate the “permalink”, “title URL”, “durable URL”, etc. If unsure, test by opening a different browser (ex.: if you are using Firefox, open in Chrome) and paste in the URL Now, simply paste the link in Blackboard or anywhere - our server will handle the authentication and access Some databases allow you to link to segments and create clips and playlists.
