1 VORM Art. 18 AB: LOCUS REGIT ACTUM Principle Locus Regit Actum has been accepted and enforced in many countries ( see p. 289 book: HPI Indonesia jilid III bag 1 )
2 See p. 290 of the book : Art. 18 AB is enforced for: a. Any legal acts conducted in Indonesia b. Any legal acts conducted abroad c. Any legal acts conducted by Indonesians d. Any legal acts conducted by foreigners.
3 Therefore: Any acts performed by Indonesian citizens or foreigners, will be recognised as valid, if those acts have been conducted by complying all the formal requirements of the country where they performed the act. BUT REMEMBER: For substantive/ material requirements of any legal act, Indonesians must comply with Indonesian law, no matter where they perform the act

5 LEX REI SITAE The principle of Lex Rei Sitae has been accepted in many countries. History of the principle: During Middle Ages, there was need to solve issues involving commercial transactions between traders belonging to different cities and countries.
6 Therefore, they developed the theory of statuta. There are 2 types of Statuta theory: 1. Statuta personalia The law/status of the person governs their goods/properties. 2. Statuta realia Lex Rei Sitae: the law where goods are situated, is the law that governs the property rights of the goods.
7 In Indonesian legal system: For movable goods is governed under statuta personalia For immovable goods is governed under Lex Rei Sitae principle (see Art. 17 AB)
8 Art. 17 AB: Mengenai benda-benda tidak bergerak, berlaku hukum dari tempat dimana benda-benda itu terletak. See the example on p. 316 Lex Rei Sitae determines: 1. The ownership of the immovable goods. 2. Other issues related to property rights of the immovable goods. 3. The qualification of immovability of the goods.
9 The principle of Lex Rei Sitae (Art. 17 AB) overrides the principle of Locus Regit Actum (Art. 18 AB). Locus Regit Actum TIDAK DAPAT DIBERLAKUKAN untuk perbuatan- perbuatan yg bersangkutan dengan penciptaan, peralihan, perubahan, dan pembatalan atas hak kebendaan benda tidak bergerak. 10 Untuk benda-benda tidak bergerak, selalu berlaku hukum dari tempat dimana benda- benda tidak bergerak tsb berada, baik itu untuk syarat materiilnya maupun syarat formilnya (vorm) LEX REI SITAE
