In recent years international organizations such as UN, ILO OECD and EU have been considered Corporate Social Responsability a new concept included in the goal of sustanaible development: “the most competitive and dynamic knowledge-based economy in the world, capable of sustainable economic growth with more and better jobs and greater social cohesion" adopted by the Lisbon Summit of March 2000, and to the European Strategy for Sustainable Development.

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO “In July 2001, the Commission presented a Green Paper “Promoting a European Framework for Corporate Social Responsibility”. The aims of this document were, firstly, to launch a debate about the concept of corporate social responsibility (CSR) and, secondly, to identify how to build a partnership for the development of a European framework for the promotion of CSR. The COMUNICATION FROM THE COMISSION IN 2002 defined CSR as “a concept whereby companies integrate social and environmental concerns in their business operations and in their interaction with their stakeholders on a voluntary basis”

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO CSR can contribute to sustainable development, while enhancing Europe’s innovative potential and competitiveness, thereby also contributing to employability and job creation promoting CSR is central to the new partnership for "growth and jobs" as well as for implementing sustainable development objectives. The Commission offers close partnership, with Member States, with business and with all stakeholders involved to make Europe a pole of excellence on CSR

DE LA ECONOMIA SOCIAL RSE CSR tries to achieve a new model of companies and bussiness : Combining profits with the implementation of adequate social and environmental practices. Fostering the participation of employees, workers, shareholders, consumers and suppliers, or others stakeholders involved. Enhancing the responsible behaviour taking into account social and environmental issues of enterprises.

DE LA ECONOMIA SOCIAL RSE The government aims to implement the suitable measures in order to achieve the goals of the European Strategy for Sustainable Development. Promoting CSR policies, under a voluntary basis and complementary to the law. The fomenting policies are based on: The transparency of companies (shareholders, consumers, workers, suppliers, employees and managers). Fostering CSR to all enterprises, including an specific approach to SMEs Improving the knowledge about CSR and facilitating the exchange of experience and good practice. Evaluation and Measurement, reporting and assurance.

They are expected to exercise critical choice and encourage good products in a good companies. To Support the labour and social policies, concerning equality, fighting against the discrimination on women, enhancing the right to the labour and family conciliation of workers and employees, improving and fostering the stable hiring, promoting a life long learning cycle, taking care on health and safe labour conditions, and considering the inclusion of social excluded persons (persons with disabilities). To implement the CSR principles in the scope of governments and public sector.

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO In march 2005 The Ministry of Labour and Social Affairs created a Technical Advisor Comittee of Experts on CSR called “FORO DE EXPERTOS”. In july 2007 the Experts Forum launched its REPORT on CSR. This Committee included 47 core members on behalf of all the CSR stakeholders: Foundations and associations of important companies in the scope of CSR NGOs from different fields such as environment, human rights, consumers, social economy, disability. Experts from the university and researchers. Ministry of Labour and Migration, Ministry of Economy, Ministry of Industries and Trading, Ministry of Environment, Ministry of health and Consumption, Ministry of Public Administration, Ministry of International Affairs and cooperation, and Ministry of presidency

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO Corporate Social Responsibility is, besides the strict compliance with the legal duties in force, the voluntary inclusion in its governance and management, in its strategy, policies and procedures, of the social, work-related, and environmental concerns, as well as those concerning the respect to human rights that arise in the transparent relationship and dialogue with its stakeholders, in this way taken on the responsibility for the consequences and impacts of its actions.".

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO The Experts´Forum focused the discussion on the CSR report and the credibility for the companies. Government supports the idea of maximum transparency with real information of social an environmental performance and the need of assesment in order to verify the policies and good practices of the companies. Government should promote the standards and guidelines of reporting, with a great consensus on the adequate indicators. This information could be the basis for implementing public policies on CSR.

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO The Experts´Forum considered the situation in Spain, the committments and actions from the spanish companies and public sector In the spanish context, we have to consider CSR as a progressive cross-cutting issue.In recent years the number of initiatives and projects from the companies, NGOs and other institutions on CSR had experimented a huge increase at central, regional and local level. Communications on progress according UN Global Compact in the areas of human rights, labour, the environment and anti-corruption. GRI sustainability reports

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO V Enhancing CSR and Sustainable development Public procurement: : According to the new law on public contracts, it can be required social or environmental clauses in the aplication for public procurement contracts. Promoting Social Responsible Investments (SRI) as a “gearbox” for this new development of companies. Pension reserve fund of Social Security: taking account of social, environmental and ethical concerns in their investment decisions

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO VIEncouraging companies to report on CSR VII Promotion of CSR in SMEs VIII The involvement of enterprises in development Setting up the national CSR Council, where the partners are the representatives of the bussiness organtizations, trade unions and other organizations representing the different sensitivities in the society, as well as Public Administrations, with the aim to act as an advising and consultative body of the Government.

DE LA ECONOMIA SOCIAL DEL FONDO SOCIAL EUROPEO In december 2007, bussiness organizations representatives, trade unions representatives and central government, launched by consensus, the document of CSR agreement, including 10 proposals for the promotion and development of CSR in Spain CSR is a joint engagement on economic, social and environmental concerns applied by companies, private and public organizations, that means an added value to the strict compliance with the legal duties in force, contributing to achieve the economic and social progress in a sustainable development framework.

DE LA ECONOMIA SOCIAL RSE CSR Council OBJECTIVES: CSR Council OBJECTIVES: To be a multistakeholder CSR Forum of debate among main social partners (CCOO-UGT-CEOE-CEPYME), governments (Local, regional and central level ) NGO,s and other CSR institutions and foundations To enhance CSR initiatives as a Government adviser with an special regard to the SMEs. To inform, where applicable, on the public initiatives and regulations that affect the proceedings of companies, organizations and institutions (private and public sector) To promote standards and characteristics for reports on CSR To analyse the spanish CSR development and to inform about european and international CSR experiences.

DE LA ECONOMIA SOCIAL RSE CSR Council FUNCTIONS: To issue opinions and to carry out studies on CSR To draw up and submit an annual report to the Government To constitute a Follow-up CSR process in Spain (Observatory) To promote and reinforce CSR initiatives National and international cooperation, with participation in CSR Forums

DE LA ECONOMIA SOCIAL RSE Council five working groups: WG1: The CSR Role against the economic crisis and the new production model WG2 : Transparency: Promotion of the standards and characteristics of the CSR and sustainability reports WG3: Responsible consumption and Social Responsible Investments WG4: Education, Training and widespreading of CSR WG5: Social Cohesion, diversity and development cooperation

DE LA ECONOMIA SOCIAL RSE Congress Proposal ( June 2009) 11 points to take into account by Government in order to enhance CSR, regarding subjects such as transparency and reporting, education, responsible consumption, social investments, public procurement, human rights, and promotion of dialogue between Stakeholders. This proposal is not law

DE LA ECONOMIA SOCIAL RSE CONCLUSION Taking into account CSR as a voluntary and complementary issue, Government aims to enhance and to stimulate enterprises to implement CSR good practices Multistakeholder dialogue plays a key role to reach out the effectiveness of CSR public policies (CSR COUNCIL) Public Administrations should have an important role to play in being socially responsible as an employer, as a consumer, as investor and must achieve the suitable transparency to have a CSR credible processus
