4. Competent lift truck operators must know: 1. How to operate the particular class of truck to which they have been assigned 2. HSE may prosecute either or both the Employer and Employee for any contravention of their Duties Should the Health & Safety Executive prosecute for contravention of the regulations you can expect a fine of up to £20,000 or a jail sentence of up to 1 year in a magistrates court, or both. 9. Is it reasonably practicable to do this job in this manner? Is it also reasonably practicable to assume that these machines are within their capacity and therefore safe to use for this job?
