4 Legal / Ethical Expectations Of the factors that are within the control, the quality of the teacher is the one thing that has been proven to have the most significant on the success of the student. Legal Governing Statutes NC General Assembly & State Board of Education Policy Avenue to voice your concerns or complain Non-Discrimination on basis of race, gender, color, national origin, political affiliation, age or disability Workplace- prohibits racial or sexual harassment Equal Employment Opportunity Open Records Law on public employees Drug Free Work Place Protecting employees and children with a social media policy Merit based recruitment and staffing Providing reasonable accommodation for individuals (Americans with Disabilities Act) Preventing violence in the work place

5 Legal / Ethical Expectations Of the factors that are within the control, the quality of the teacher is the one thing that has been proven to have the most significant on the success of the student. Ethical Testing/Assessment Code of Ethics Administrative Code – professional conduct for educators Protect confidential information/data (SSN, Employee ID, etc.) Reporting Policy- arrested or issued a legal restraining order or charged with a criminal offense Any local board of education policy covering ethical behavior

6 Legal / Ethical Expectations Teachers are intended by parents, citizenry and lawmakers alike to serve as good examples for their young charges. Their character and conduct may be expected to be above those of the average individual not working in so sensitive a relationship as that of teacher to pupil. It is not inappropriate or unreasonable to hold our teachers to a higher standard of personal conduct, given the youthful ideals they are supposed to foster and elevate. Faulkner v. New Bern-Craven County Bd. of Educ., 311 N.C. 42, 59, 316 S.E.2d 281, 291 (1984).

(AP) - Several teachers in the Charlotte-Mecklenburg school district face discipline for posting images and material on the social-networking site Facebook that school leaders find objectionable. District spokeswoman Nora Carr told the Charlotte Observer that officials are recommending that one teacher be fired for writing that she teaches "in the most ghetto school in Charlotte. (continues)

11 Other pages discovered by WCNC-TV of Charlotte included photos of female teachers in sexually suggestive poses and a black male teacher who used a racial slur to describe an activity. A special-education teacher wrote, "I hate my students!" Carr said four teachers face unspecified discipline that is less than suspension or dismissal

12 Attire The effective teacher dresses appropriately as a professional educator to model success. As you are dressed, so shall you be perceived; and as you are perceived, so shall you be treated.
