2 2 INTRODUCTION Defence Housing Authority (DHA) over the years has come to symbolize as a residential estate that focuses on provision of best educational recreational and quality civic amenities and good living environments to its residents. DHA has come to be known as a model housing scheme that maintains the highest standards of excellence and all its undertaking. You being the member of DHA and owner/transferee of plot in DHA are required to acquaint yourself as how to start the construction of your residential house or your commercial building. A new concept of ONE WINDOW OPERATION is being introduced to facilitate the owners. In preceding paras a guideline in this regard is given for you better understanding which will facilitate for planning of construction of building.

4 STEP 1 - ISSUE OF SITE PLAN
4 STEP 1 - ISSUE OF SITE PLAN Why Site Plan Is Necessary. It is the first major documents required for the planning to construct a building and is issued to clearly show following:- Nomenclature of plot The direction of North The boundaries of the site on which it is proposed to be constructed. Information of adjacent roads/streets and other properties. Name of owner For issuance of Site Plan following documents are required to be deposited at TP&BC Directorate, DHA:- Photocopy of Almt Order/Tfr Order/Mutation/Division. Photocopy of CNIC of owner. 7 STEP 2 – EXECUTION OF SUB LEASE ‘A’
7 STEP 2 – EXECUTION OF SUB LEASE ‘A’ Sub Lease ‘A’ The Sub Lease ‘A’ entitles an allottee/transferee of residential/commercial plot the permission to commence construction after the approval of building plan. Transferee/allottee on the bases of this document can also apply for loan from the House Building Finance Corporation or any bank or financial institution. Procedure Before applying for Sub Lease ‘A’ please purchase copy of DHA Bye-Laws for better understanding. You have to apply for Execution of Sub Lease ‘A’ on a prescribed form issued from DHA Lease Branch and submit alongwith following documents:- Application to the Administrator requesting Registration of Sub Lease ‘A’ with full particulars of the owner. 10 STEP 2 – EXECUTION OF SUB LEASE ‘A’ Processing of Documents After receipts of documents, applicant is given a date of execution of Sub Lease ‘A’ with Sub Registrar Clifton Town-I located in DHA. Documents are scrutinized by Lease Branch and TP & BC Dte. Sub Lease ‘A’ documents are signed by Secretary DHA and Coopted Member DHA Executive Board. Contd..

11 STEP 2 – EXECUTION OF SUB LEASE ‘A’ On due date, Sub ‘A’ Lease document will than be submitted with Sub Registrar-I located in DHA Head Office Phase-I, for registration. Owner or his attorney will personally be present before the Registrar for signing and affixing of thumb impression in Registrar’s Record. Sub Lease ‘A’ document is finally received by the owner or his attorney from Sub Registrar after Micro Filming of these documents by District Registrar Karachi. Till the time Sub Lease ‘A’ document is not received from Sub Register the receipt/slip issued by Sub Registrar holds good for further processing. Contd..

20 NOW THIS INDENTURE WITNESSETH AS FOLLOWS:-
20 AND WHEREAS under the lease and by virtue of the said allotment/transfer order the sub-lessee is entitled to enter upon the said plot of land for the purpose of constructing a building thereon. NOW THIS INDENTURE WITNESSETH AS FOLLOWS:- That the lessees do hereby authorise and permit the Sub-lessee to enter upon the said plot of land for the purpose of constructing a building thereon in accordance with the terms and conditions of the lease and the terms and conditions shown on next slide:- Contd..

21 21 (1) The Sub-lessee shall at his own cost and within the period of years from the date of execution of this Sub-Lease erect, complete and finish upon the said plot a residential house in accordance with the plan and design approved by Authority constituted under the lease (hereinafter called the Authority) subject to the condition that no construction work shall be started by the Sub-lessee on his plot unless the preliminary stages of development shall have been completed and permission in writing shall have been obtained from the Authority. In the event of the Sub-lessee failing to comply with the conditions hereinafter appearing, the lessor, or the lessees, may at his/their discretion recover from the Sub-lessee as agreed liquidated damages by way of penalty, a sum equal to half percent of the estimated cost of the works remaining incomplete for every month the work remains incomplete subject to maximum of 5 percent of the estimated cost of the work remaining unfinished after the due date. Provided that if the Sub-lessee fails to complete and finish the building by the date finally fixed by the Authority, the lessees may terminate this Sub-lease and resume the plot and any structure or structures erected thereon. 22 22 (2) The construction shall be done in accordance with the building Bye-Laws and the rules laid down by the competent local Authority. (3) With the execution of these presents the rights and liabilities accrued under the lease shall devolve upon the Sub-lessee and he shall be bound by such terms and conditions of the lease as are expressly or by necessary implication or analogy applicable to him. The Sub-lessee shall deposit with State Bank of Pakistan or pay any such office as may from time to time be prescribed by lessor: (i) Premium of the said plot at the rate of Rs per square yard in eight equal half-yearly installments; the payment of the first installment being made on the day of the execution of these presents. (ii) Ground rent in advance on or before the first day of July every year at the rate of paisa per sq. yard per annum. The first payment shall be made on the first day of July, next following the day when Sub-lessee takes possession of the plot allotted to him. Contd..

23 23 (5) The Sub-lessee shall pay all the calls (hereinafter called "development charges") made by the lessees from time to time at their office and the decision of the Executive Board of the lessees as to the amount so payable shall be final and binding on the Sub-lessee. All arrears of payments due and payable by the Sub-lessee shall be recoverable as arrears of land-revenue. 2. It is hereby agreed that on the completion of the building in accordance with the said terms and conditions and on the Sub- lessee complying with the said rules, he shall be entitled to a lease of the said plot for 99 years in Form ‘B’ appended to the lease and IT IS HEREBY FURTHER AGREED that unit such lease has been granted by the lessor the Sub-lessee shall not have any right or interest in the said plot except that of a bare licensee and shall not without the previous permission in writing of the lessees and the lessor transfer his interest in the area allotted to him either in part or whole, except for the purpose of raising loans from the House Building Finance Corporation, authorised Banks and Insurance Companies for construction of building thereon. Should the Sub-lessee commit, breach of any of the terms and conditions of these presents or should he neglect to comply with any direction given to him by the lessees, or the Authority or in any other respect fail to carry out his obligations under these present for reasons not beyond his control or fail to pay the development charges, the lessor or lessees shall have the right to terminate this Sub-lease and on such termination the payment made by him to the lessees or/and the lessor shall be forfeited and he shall have no further claim whatsoever against the lessor or the lessees except at the option of lessor / lessees he may receive compensation to the extent of the amount of actual expenditure incurred by him on building on the plot. Provided that the lessor or lessees may in their absolute discretion have the building sold out, either by public auction or private contract, in which case the Sub-lessee shall be entitled to the net sale proceeds of the building or to the amount of actual expenditure incurred by him on having the building constructed, whichever is less. 32 32 (1) The Sub-lessee shall at his own cost and within the period of 3 years from the date of execution of this Sub-Lease erect, complete and finish upon the said plot a commercial building in accordance with the plan and design approved by Authority constituted under the lease (hereinafter called the Authority) subject to the condition that no construction work shall be started by the Sub-lessee on his plot unless the preliminary stages of development shall have been completed and permission in writing shall have been obtained from the Authority. In the event of the Sub-lessee failing to comply with the conditions hereinafter appearing, the lessor, or the lessees, may at his/their discretion recover from the Sub-lessee as agreed liquidated damages by way of penalty, a sum equal to half percent of the estimated cost of the works remaining incomplete for every month the work remains incomplete subject to maximum of 5 percent of the estimated cost of the work remaining unfinished after the due date. It is the Plan prepared by the owner through the DHA’s authorized architect showing the proposed detail of the arrangements of intended building works within the property line. Procedure After receiving the Site Plan and execution of Sub ‘A’ Lease, owner will get the building plan prepared through DHA’S APPROVED ARCHITECT and submit Building Plan to Central Control Cell located at DHA Office along with following documents:- Application address to Dir TP&BC for submission of Building Plan. The lessee shall subject to the above conditions, be at liberty to sell, assign or otherwise transfer his right under this lease but such transfer shall in every cast take effect subject to the conditions aforesaid and to the obligation of observing and fulfilling the same, provided always that the liability of every transferor or/and transferee or their duly constituted agents shall have been served upon the Lessor. Shall the lessee commit breach of any of the conditions of this lease, the Lessor shall after reasonable notice to the lessee be entitled at any time thereafter to determine this lease whereupon all rights of the lessee in the said plot of land and in any buildings, erections, building materials or the like, standing thereon shall absolutely cease and it shall be lawful for the Lessor and their officers on such default to enter upon the said plot or any part thereof in the name of the whole and take possession of the same and of all buildings, erections, building materials or the like thereon, axed hold the same to the use of the Lessor free from all encumbrances provided that any such buildings, erections, building materials or the like may be removed as hereinafter provided. If on the expiry of the lease the lessee shall be desirous of renewing the lease, he shall be entitled to a renewal of the lease for such further period and upon such terms as the Lessor may determine. 11. The lessee shall in the same manner be entitled to further renewals on the expiration of each period of renewal. But should the lessee not desire such renewal, or not consent to any of the conditions Imposed by the Lessor as aforesaid or should the lease be determined on account of a breach of any of the terms, the said plot hereby leased shall revert to the Lessor and all buildings, erections, building materials, or the like thereon shall on such expiration or determination of the lease become the absolute property of the Lessor provided always that for a period of six months from the date of such expiration or determination the lessee shall have the right to remove all such buildings, erections, building materials or the like thereon, and any buildings, erections building materials or the like not removed within the same period shall become the absolute property of the Lessor. (a) The lessee shall pay all the development charges and other dues as may be demanded of him/her from time to time bytheAuthority and the decision of the Executive Board of the Authority as to the amount so payable shall be final and binding on the lessee. (b) The lessee shall comply with and observe all the rules and bye-1aws of the CCB & DHA. (c) The said plot shall not be sub-divided or amalgamated with any other plot except with the previous consent in writing of the Lessor and subject to such terms as the Lessor may from time to time impose. The lessee shall have the right subject to the above conditions to sell, assign, or otherwise, transfer his rights in the said plot with or without building thereon, but such transfer shall in every case be subject to the above conditions and to the obligation of observing and fulfilling the same; Provided always that the liability of every transferor under this lease shall continue until a written notice of such transfer signed by the transferor and transferee or their duly constituted agents has been served upon the Lessor and the Lessor’s consent to such sale, assignment or transfer shall have been obtained. These are given below:- Approved. Approved in writing by PDOHA. Architect. A person currently registered with Pakistan Council of Architects and Town Planners (PCATP). Building Plan. The Plan showing the proposed detail of the arrangements of intended building works within the property line.

Executive Board may grant Registration in Category-‘B’ to individuals / Companies / Firms / Organizations / Establishment / Foreigners etc, on payment of requisite membership fee. Category ‘C’ Members. For person / persons who, through gift / inheritance, acquire any share / interest in any plot / property allotted initially either to a member of the dissolved society or to persons registered with the Authority .

For owners of small Flats/Shops measuring ie Flats up to 1200 Sq Feet and shops upto 250 Sq Feet respectively. Category ‘S’ Members. For persons who are allotted property through special allotment and widows of shuhada.

107 107 TERMINOLOGIES Commercial Building. A building constructed for commercial use on a commercial plot and may have a combination of commercial and residential (apartments) units/floors. Completion Plan. “As Built Plan” submitted to DHA for the purposes of obtaining approval and occupancy certificate. DHA’s Bye-Laws. Rules and regulations passed by s Executive Board of DHA ,in exercise of the powers vested under Article 23 of the Presidential Order-7 of 1980 ,for the construction of building in DHA.

108 108 TERMINOLOGIES Demarcation. It is the physical demarcation of plot which will be verified at site by DHA Staff after physical erection of boundary pillars by the owner. Engineer. A person currently registered with Pakistan Engineering Council (PEC) as Engineer. No Objection Certificate (NOC) from DHA. It is the inspection carried out by staff of DHA during construction at different stages to verify that the construction is being carried out as per approved plan. Owner. A person (allottee or transferee) holding title to a piece of land or construction thereupon

109 109 TERMINOLOGIES PDOHA. Pakistan Defence Officers Housing Authority Karachi. Residential Building. A building or part thereof designed, adopted or used for human habitation only. Revised or Amended Plan. A previously approved drawings or plans resubmitted for fresh approval with amendments in accordance with PDOHA Bye-Laws. Site Plan. The site plan is issued to the owner to indicate the location of plot for preparation of building plan.

110 110 TERMINOLOGIES Sub Lease ‘A’. The Sub-Lease ‘A’/License entitles an allottee/ transferee of a residential/commercial plot to obtain leasehold rights, by execution of which an allottee/ transferee will be able to obtain loan from the House Building Finance Corporation or any Bank or Financial institution. This will also entitle him/her to step on the plot and commence construction after the Building plans are approved by the Cantt Board/MEO. This lease has to be executed before start of construction work.

111 111 TERMINOLOGIES Sub Lease ‘B’/’C’. These are 99 years Leases executed between the MEO, on behalf of the President of Pakistan, the Authority and the allottees/transferees who, so ever obtain these Leases will have the Lease hold rights of the plot with construction thereon for about 99 years, renewable after the expiry of the said period. Lease ‘B’ is executed in respect of residential plots and Lease ‘C’ in respect of commercial plots only on completion of the building. Violation Any construction which is carried out against DHA Rules Regulation or approved building plan.
