2 Key Considerations The Internet’s architecture supports online freedoms. Individuals and organizations can develop new technologies and applications that enable the exercise of basic freedoms by building upon the Internet’s open standards. An architecture supporting borderless expression Security should not be sought at the expense of individual rights. We should consider ways in which security can be achieved without disproportional risks to expression or privacy online. The necessity, legitimacy, proportionality, and fairness of a situation must be determined before a lower level of protection is justified. Finding a new equilibrium for online rights

3 Doesn't solve the problem. Interferes with cross-border data flows and services. Undermines the Internet as a single, unified, global communications network. Content filtering and blocking Ineffective, likely to decrease trust in the Internet, and no due process. Eavesdropping on private conversations doesn’t increase security. Restricting or weakening of encryption technologies Lack of legal interoperability across jurisdictions. Holding intermediaries liable for the content they host might encourage companies to err on the side of caution and to too easily remove content. Does not promote freedom of expression or association. Liability imposed on Internet intermediaries Challenges We need solutions that do not harm the overall stability and interoperability of the Internet and which respect all human rights.
