The use of these instruments by operators shall remain voluntary These tools are available to sectors/countries that whish to implement them: consideration shall be given to “different situations” between EU countries and/or sectors. But … MS shall recognize organisations at their request provided that they fulfill the conditions laid down in EU Regulation. 15 Extension of rules and financing 1.Art. 110 provides the possibility for MS, under certain conditions and at the request of a PO, APO or IBO to make binding agreements agreed within that organisation to non-member operators. 2.Those who benefit from activities covered by such agreements shall pay the financial contributions for costs directly incurred as a result of pursuing the activities in question (art. 111) Copa-Cogeca | The voice of European farmers and their cooperatives | 15

16 “Single CMO” Regulation - “a major step forward” Extension of rules and financing  These proposals may be of interest for operators and MS by underpinning “already existing” mechanisms in certain countries’ national legislation.  The precise conditions and activities covered by the “extension” shall be further defined within EU legislation. 18 “ Single CMO” Regulation – “some room for improvement” Need for “more precise” definitions and recognition criteria 1.Copa-Cogeca calls for a more “precise definition of POs: POs shall be formed on the initiative of farmers who are the “driving force” for defining the organisations’ strategies and practical operations decisions. POs must fulfil clear objectives and tasks defined within EU legislation Adapting production to market needs, concentrating supply and marketing members’ production and optimising production costs. POs must fully assume the "economic responsibility" assigned to them POs shall play an active role in terms of marketing their members’ production. A Clear distinction should be made between objectives that POs, APOs and IBOs shall fulfil (see art.110) IBOs allow dialogue between actors along the supply chain and may carry out actions in the areas of promotion, development of standard contracts, promotion of best practices, economic transparency, stabilization of markets,… POs must play an “active economic” role, which is to concentrate supply and marketing of production’ members. 25 “Single CMO” Regulation – articulation with EU competition rules Limitations imposed by EU competition rules legislation A special approach should be allowed towards POs or APOs’ activities aiming at better concentration/integration of primary producers (eg: joint production, marketing of agricultural products,…) Margin of flexibility should be permitted as regards IBOs activities provided that “they do not distort or eliminate competition, or create discrimination.
