2 Planning Commission Hearing March 12, 2014, P/C approved a Design Review Permit: - Demolition of the existing 1,227 sq. ft. two-story single- family residence - Construction of a 1,941 sq. ft. two-story single-family residence - One-car garage and one uncovered off-street parking space Tree Removal Permit to remove one heritage tree - 32-inch Canary Island Date Palm

3 Appeal March 21, 2014, property owners of 208 Third St appealed project on three main grounds:  Privacy impacts to 208 Third Street  View impacts to 208 Third Street  Design does not:  Maintain neighborhood character  Contribute to the design diversity of Sausalito

4 Design Review Permit Findings – Privacy Section 10.54.050.I  The project provides a reasonable level of privacy to the site and adjacent properties, taking into consideration the density of the neighborhood, by appropriate landscaping, fencing, and window deck and patio configurations.

5 Design Review Permit Findings – Privacy  Minimal amount of windows on North Elevation, most of which are clerestory windows  Screen on lower patio rear of residence

6 Design Review Permit Findings – Views Section 10.54.050.D  The proposed project has been located and designed to minimize obstruction of public views and primary views from private property.

7 Design Review Permit Findings – Views  Roof is 2’ 4” lower at rear of residence Removal of the palm tree from the rear yard Expanded some existing views from neighboring properties

8 Views and Privacy Impacts – Story Poles Story poles need only show decks if Staff determines they have potential to impact neighboring properties (ref: C/C Resolution No. 4501). Staff determined that story poles were not required for the rear deck In light of the appeal, new story poles were installed and account for the rear deck

9 Design Review Permit Findings – Design Section 10.54.050.B  The proposed architecture and site design complements the surrounding neighborhood and/or district by either:  a) Maintaining the prevailing design character of the neighborhood and/or district or  b) Introducing a distinctive and creative solution which takes advantage of the unique characteristics of the site and contributes to the design diversity of Sausalito.

10 Design Review Permit Findings – Design Planning Commission found the project consistent with finding b) since: Curved roof allowed for some existing views to be increased Design provides diversity and interest along the streetscape that will contribute to design diversity of Sausalito and Old Town neighborhood.

11 Geotechnical Report  May 21, 2013 – Application submitted, with Geotechnical Investigation.  June 6, 2013 – City Engineer reviewed the plans and geotechnical report dated November 21, 2012, and provided Condition of Approval requiring a Geotechnical Report be submitted and reviewed by the City Engineer prior to issuance of a Building Permit.  June 11, 2013 – Revised Geotechnical report submitted.

12 Geotechnical Report  March 12, 2014 – Planning Commission reviewed the project.  Planning Commission approved Resolution 2014-06 which contained  41. Geotechnical Engineering/Foundation Design/Shoring Design – A geotechnical report shall be prepared by a licensed geotechnical engineer. The report shall evaluate groundwater and develop recommendations for adequate structural foundations, on-site parking lot pavement structure, subdrainage to collect and convey groundwater discharges to public drain system. The report shall also evaluate and make recommendations as necessary to manage and control soil creep as unusual findings with regard top expansive soils. The report shall be evaluated and approved by the engineering staff prior to issuance of Building Permits.

13 Recommendation: Deny the appeal and uphold the Planning Commission decision to approve: Design Review Permit to demolish the existing single-family residence and construct 1,941 sf, two-story dwelling with one-car garage and one uncovered off-street parking space; and Tree Removal Permit to remove one protected tree
