2 2009 Changes in the MOU Includes for Sergeants:  All benefits that Sergeants previously had in their 800 Series Comp Plan (Sgt.’s Plan A)  Everything currently in the Police Officers MOU now includes “Sergeants”. (Including Officers’ Plan B)  Thus, In a few instances Sergeants benefits are greater than Police Officer benefits. (new paragraphs in the MOU)

3 2009 Changes to MOU Article V Merit Increases  Police Officers shall become eligible for merit increases beginning with the first pay period after the completion of one year’s employment and shall be eligible for future merit increases on their anniversary date.  DEFINED THAT SERVICE NEED NOT BE CONTINUOUS.  Anniversary dates will be adjusted as necessary.

4 2009 Changes in the MOU YEARS OF SERVICE Article V  Added Police Sergeants have a anniversary date reflecting the actual date they were promoted.  Officers and Sergeants who retire or resign their employment but return to work within one year will have such time deducted from their years of service, resulting in an adjustment to their anniversary date.

5 Changes to 2009 MOU Lateral Entry Article V  For the purposes of the wage schedules, Police Officers hired under the Lateral Entry Hiring Program will be granted years of service according to the terms of the program. Such years of service shall be included in the calculation of ALL leave time benefits (vacation accrual/carryover, personal leave), but shall not apply to the computation of longevity pay, departmental seniority or the calculation of short term disability benefits.

6 2009 Changes to the MOU Article III Association Rights  Association reps will be allowed time off with pay to attend conferences and conventions. This time off will not exceed a total of 320 hours per fiscal year. (Up from 240 last year) (Up from 240 last year)

9 2009 Changes to the MOU Article VI Hours of Service G. Standby  Police Officers and Police Sergeants directed by their Division Commander or designee to keep themselves available for City service during otherwise off duty hours will be paid one (1) hour of straight time for each calendar day on standby. This compensation shall be in addition to any callout pay or pay for time worked the employee may receive during the standby period.

Departmental Seniority (Police Sergeants only) Police Sergeants will bid shifts, days off and division work assignments by time in rank (date promoted) when a conflict does not exist with a departmental policy or operating efficiency. Rules for taking Vacation: A Police Officer or Sergeant may request vacation time which the Police Officer or Sergeant has already accrued or will have accrued prior to the requested dates. Police Sergeants may accumulate vacation (including both earned vacation and sick leave time conversion time [if on plan A]) according to their credited years of employment with the city up to the following maximum limits: 1. Up to 9 years= 240 hours 2. Up to 14 years = 280 hours 3. After 14 years = 320 hours FYI: Officers do not have the 320 hour provision

14 2009 Changes to the MOU Article IX Personal Leave Plan B  All Police Officers or Sergeants on Plan A will allowed to convert to Plan B during the 2009 City wide conversion window. (Fall of 2009)  The City and Association agree to jointly discuss the terms of any conversion before opening the conversion window. Any agreed upon terms of the conversion window will be distributed to each employee on Plan A as an appendix to the MOU.

15 2009 Changes to the MOU Article IX Sick Leave Plan A  The City and the Association agree to jointly discuss changes to Plan A. The City and Association agree to make a recommendation or recommendations to the Mayor no later than March 1, 2010 on the recommended changes.

16 2009 Changes to the MOU Article IX Retirement G. Retirement Benefit “Plan A” Police Sergeants: 1. Sergeants will be paid in cash; at their current pay rate a sum equal to 25% of their accumulated sick leave (OR) 2. Convert the value of 50% of sick leave towards Health Insurance premiums. (This is not the 501c-9) FYI: Police Officers on Plan A convert 50% of sick leave into the 501C-9 Nationwide account

Amount of Personal Leave: Each Police Officer and Sergeant shall be awarded personal leave at the beginning of the second pay period in November. City Contribution: Police Officer and Sergeants may not carry over more than 80 hours of personal leave to the next plan year, which begins the second pay period of November 15, 2009. 21 2009 Changes to MOU Article X Bereavement Leave  Plan A had a more liberal bereavement leave benefit. (if a relative not listed above passed, one work shift was granted)  Plan B required an employee to use one of their personal leave days to attend the funeral.  NOW, Plan A and B are the same; using the old Plan A benefits.

22 2009 Changes to MOU Article XI Uniform Allowance In addition to the current Uniform Allowance: 1. Police Sergeants will receive one (1) addition uniform pant, shirt and tie. 2. During the term of this MOU, both parties agree to jointly study a Quartermaster System for all uniforms and uniform equipment. 3. If an agreement is made an addendum to this MOU will be added.

23 2009 Changes to the MOU Article XI Blood Draw Call-out 1. Minimum of 2 hours of pay at one and one half 1 ½ times their pay rate. (or actual time worked whichever is greater) 2. Must be able to respond to the scene within 30 minutes of being called. 3. City must call off-duty officers first before any on duty officers can be used. 4. If an on duty officer is used and the draw extends past the scheduled end time, the officer will be paid for two hours of one and one/half 1 ½ times their rate of pay.

24 2009 Changes to the MOU Article XVIII Committees Newly added committees: 1. Secondary Employment Committee:  The SLCPD and the Association will jointly establish a secondary employment committee to make policy recommendations to the Police Chief related to all aspects of secondary employment.  This committee may review an employees suspension from secondary employment and provide the chief a recommendation related to that suspension.

25 2009 Changes to the MOU Article XVIII Committees Newly added committees: 2. Car per Officer committee:  The SLCPD and the Association will jointly establish a Car per Officer committee to make policy recommendations to the Police Chief.  This committee may review an employees suspension the program and provide the chief a recommendation related to that suspension.

COLA Increase committee:  The City and the Association will jointly establish a committee to discuss a funding mechanism to increase retirees’ COLA as allowed by Utah statute.  This committee will provide a recommendation to the Mayor no later than March 1, 2010.

27 2009 Changes to the MOU Article XX Layoffs  Whenever it is necessary to reduce the number of Police Officers or Police Sergeants in SLCPD because of lack of work or lack of funds, the City shall first lay off probationary Police Officers or Sergeants.  A laid off Sergeant shall be returned to a Police Officer position.

28 2009 Changes to the MOU Article XX Layoffs  If further layoffs are necessary, Police Officers shall be laid off in inverse order of departmental seniority as a P.0. and rehired pursuant to the Rules established by the SLC Civil Service Commission.  In the absence of a reason for not rehiring a laid off Police Officer, the Chief’s intent is to rehire laid off Police Officers based upon departmental seniority.

29 2009 Changes to the MOU Article XXVI Fiscal Year 2010 Economic Crisis 1. Due to the current economic crisis, the City will suspend payment of one and one-half (1.5%) of the wages set forth in Appendix “A” beginning July 1, 2009 and ending no later than June 30, 2010. (Appendix “B” reflects this suspension.) 2. The City will also suspend payment of merit increases beginning July 1, 2009 and ending no later than June 30, 2010.

30 2009 Changes to the MOU DOES NOT PAYING MERIT STEPS MEAN I DON’T GET CREDIT FOR TIME WORKED? Answer: No You will still get credited time towards your benefits and will move from one pay step to the next on your anniversary date. You just will not see the pay this fiscal year. If merits are funded next year, on July 1, 2010 you will get last years merit raise and be eligible for your next merit raise on your anniversary date. Pay will not be made retroactive.

31 2009 Changes to the MOU Article XXVI Fiscal Year 2010 Economic Crisis 3. The City agrees it will review the suspensions each quarter during fiscal year 2010 to determine if it can reinstate the suspended amounts. 4. In exchange for these suspensions, the City will provide each Police Officer and Sergeant one additional personal holiday each quarter of fiscal year 2010 for a total of four additional personal holidays.
