3 The Aleutian Pribilof Islands Association, Inc., Human Services Department, Tribal Child Support Program is designed to assist parents with supporting their children emotionally, socially and economically through: Paternity Establishment & Parent Locate Child Support Order Establishment Enforcement of existing orders Review and modification of existing orders Aleutian Pribilof Islands Association, Inc. 4 Child Support Initiated by Custodial Parent (CP) or other interested party Child support can be initiated at any time before the child’s 18 th birthday A complete application needs to include the following: Name, address, and income of CP Name, address, and income of (Non-custodial Parent) NCP The name and date of birth of the children Costs of caring for children such as medical, education, child care expenses If custody is split, the percentage of time that the children are in custody of the petitioner Aleutian Pribilof Islands Association, Inc. 5 Locating NCP APIA TCSP will perform location activities including: Accessing Tribal council records Obtaining case files Obtaining collateral contacts Contacting State of Alaska Child Support Services Division Obtaining Property Records Obtaining information about occupational and professional licenses Obtaining NCP business information Obtaining information from ATAP Obtaining information from the departments of motor vehicle and law enforcement Aleutian Pribilof Islands Association, Inc. 6 Enforcement Verify Tribal enrollment Verify employment Letter to NCP with Assignment of Earnings and income statement Serve employer with Assignment of Earnings and Income Statement with cover letter Monitor monthly payments Notice of Delinquency:  Payment reminder letter to NCP  Notice includes the terms of the child support order, period and amount of delinquency, and procedures to avoid immediate withholding Aleutian Pribilof Islands Association, Inc. 7 Modifications Request must be in writing Hearing to be set within 45 days Amounts of past due Child Support may not be modified Change of Payee All parties need to be noticed Change of Custody Notarized letter Other official documents (ex. 8 Income Withholding Case Worker will issue voluntary withholding agreement ◊ Notice of Delinquency: sent when account is (1) day delinquent ◊ Order to withhold income: 15 days after Notice of Delinquency if there is no response ◊ Failure to comply with order: ▪ Suspension of hunting & fishing permits ▪ Suspension of subsistence and hunting rights ▪ Garnishment of Regional Corporation Dividends ▪ Property liens Aleutian Pribilof Islands Association, Inc. 9 What happens when the NCP has difficulties finding employment Generally calculations in child support monies include taking into account employability of NCP and types of jobs available in NCP’s geographical area Referrals will be made to assist NCP with employability such as: ◊ Job training ◊ Substance Abuse Treatment ◊ Anger Management Aleutian Pribilof Islands Association, Inc.
