1 4-H Club Finances Upcoming Changes to Iowa 4-H Policy

2 Keepers of the Clover must Provide oversight of county 4-H programs to ensure proper use of 4-H Name and Emblem Help implement a county system to manage N & E use Help educate county staff and volunteers on proper use of N & E

3 It’s the Law! The 4-H Name and Emblem are held in trust by the U.S.D.A. Secretary of Agriculture under provisions of: –Title 18 United States Code Section 707 –Section 7 Code of Federal Regulations Part 8

4 4-H Name & Emblem Has special status Used only as authorized by statute, and As authorized by Secretary of Agriculture or designated representatives

5 4-H Name and Emblem The 4-H Name and Emblem is a federally protected mark. Everyone using that mark must have authorization to do so.

6 This means Everyone! State and local Cooperative Extension Services 4-H Clubs, Volunteer Leaders and 4-H members Affiliated Committees, groups and other entities Activities and Events Incorporated Groups Commercial Vendors

7 Authorization The Secretary of Agriculture is the authorizing agent. Land-Grant Universities and the Coop Extension System are authorized to use the 4-H Name & Emblem LGU and CES are not authorizing designees of the N & E.

8 What does that mean? Within a state (or county), the 4-H N&E may be used in support of the state (county) programs, but state (county) officials may not authorize other entities beyond the scope of their program to use the 4-H N&E.

9 Approval Basics Usage for educational and character building purposes of 4-H Program Educational or informational uses are in best interest of program Usage consistent with dignity of program Usage can be properly controlled Usage is for specific time period Usage follows graphic use guidelines

10 Approval Basics No use permitted that exploits the program No endorsements (or implied endorsements) allowed No exclusive use by others Products and services need approval –Must include non-endorsement statement

11 This includes Fundraising Fundraising using 4-H N & E permitted for specific educational purposes. Must have approval of appropriate Coop Extension office (county, state, national) Approval requirement written as part of Title 7, C.F.R. (Subtitle A), section 8.9

12 Fundraising All money received must be expended to further 4-H educational programs. Must be plan to account for funds prior to authorization. Follow state policy. Includes 4-H clubs and supporting groups (friends, foundations).

13 Penalties for improper use? Authorization to use N & E may be withdrawn at any time. Immediately. Fines. Up to six months prison. Federal prison.

14 Current Policy (4-H 71LDR) 4-H Clubs should: –Establish bank account –Require two adults and youth on account –Establish budget –Prepare monthly summary –Prepare (and review) end of year summary

15 Current Policy (4-H 71 LDR) 4-H Clubs should: –Make payments in response to bill or invoice –Acknowledge in writing all receipts –Have prior approval for fundraising

16 Recommended Changes Change “Should’ to “Shall” or “Must”: –Budgets –Annual financial review –Bank accounts –Approval of payments –Monthly reports –Acknowledge all receipts

17 Recommended Changes Change “Should” to “Shall” or “Must”: –Fundraising approval prior to activity –Fundraising report following activity Prohibit club debit/credit cards Youth Experiential Education –Youth in control, adults as guide
