1 Use of the City Logo Molly, the Cow April 7, 2009 Presented at the Pre-Council Meeting

2 2 Purpose of the Briefing Discuss the City’s current policy and procedure in allowing the use of the City logo to outside users. Recommendation for future uses.

3 3 Background of Molly, the Cow On July 18, 2000, the City Council adopted Molly, the Cow as the official City logo. (M&C G-12959) In January of 2002, the City entered into an agreement with the University of Texas System (“UT”) further describing Molly’s use and appearance. In August of 2003, the City Manager issued a revised Administrative Regulation on the use of Molly, the Cow. (A.R.D-4) In 2007, the City Manager’s office began to develop a procedure to review and consider requests for the use of Molly, the Cow.

4 4 Procedure to Request the use of the City Logo for Requests Made by Outside Users Before a use is made, a request should be made to the City Manager’s office, or his designee. City Manager’s office confers with the law department on potential legal issues that may arise with the requested use. City Manager’s office decides on the use based on fairness and equitable standards set by past uses granted. If granted use of the City logo, the City enters into a License Agreement with the user.

5 5 General Principals of Copyright and Trademarks  Once federally registered, Molly, the Cow would become a Trademark.  A Trademark helps to protect the image and its use.  A Trademark can help to encourage use, based on specifications and perimeters.

6 6 License Agreements for the Use of the City Logo License Agreements are NON-EXCLUSIVE and: Describe the specific use granted, and are limited to that specific use. Set out the color and size specifications. Molly may not be printed in orange or against an orange background. And Molly may not be redrawn or altered. Molly must always be proximate to the words “Fort Worth” or “Ft. Worth”. Use must include a statement that the City Logo is used with the City’s permission.

7 7 User may not sell or transfer the use to a third party. And unless approved by the City, the logo may not be used in a common graphic or with third party names or marks, nor on any web site. User must comply with the Federal Copyright Act. User must indemnify and hold the City harmless for any copyright violations. City may issue a cease and desist notice for a violation of the agreement or any law, or upon regulatory action. Unless waived by the City Manager’s office, the User must pay a one time user fee of $200. Other Provisions of the License Agreement

8 8 Example of an Approved Use of the City Logo  Teresa’s Treasures, a gourmet gift company uses the logo on cardboard gift boxes, ribbons, water bottles, etc. (CSC No. 35490)

9 9 Current Request to Use the City Logo  Request made by Moritz Chevrolet for the use of Molly, the Cow as a chrome plastic truck decal to create a Fort Worth edition truck.  This use would need to be restrictive in the size of the decal and its placement so as to avoid the confusion that the truck is a City vehicle.

10 10 Adoption of City of Fort Worth Logo On July 18, 2000, the City Council adopted Molly, the Cow as the official City Logo. “The City and its departments utilize a single logo to identify City services, equipment and personnel. The use of a single logo makes it possible for citizens and visitors to instantly know that they are dealing with the City of Fort Worth.”(M&C G-12959)

14 14 Next Steps City is in the process of registering Molly, the Cow with the federal copyright office. Recommendation Refine the Use policy, procedure and License Agreement to protect the City’s interests.
