Integration of wine into the single CMO Commission services’ presentation for Council working group 8-9 January 2009

2 Single CMO  Council Regulation (EC) No 1234/2007  Keystone of CAP simplification  Working well in practice  Useful single reference document Brussels, 8 - 9 January 2009

3 Wine integration always foreseen  sCMO recital (8) provided that reformed wine CMO should be incorporated  Wine reform was drafted and adopted on basis of future integration into the sCMO: see recital (8) of new wine CMO Brussels, 8 - 9 January 2009

4 No policy changes  Integration of wine is a technical operation only  No scope to reopen wine reform debates  Same as was done for fruit and vegetables, milk mini-package etc Brussels, 8 - 9 January 2009

5 EP support  Overwhelmingly positive opinion from EP  493 in favour, only 4 against and 17 abstentions Brussels, 8 - 9 January 2009

6 Amending proposal  COM(2008) 489 final  Amends sCMO: looks complex but consolidated sCMO ready soon  Some minor amendments needed following health check changes to sCMO  Repeals new wine CMO (Regulation (EC) 479/2008)  To apply from 1 August 2009 Brussels, 8 - 9 January 2009

7 Structure of sCMO  sCMO divided logically into key subject matters like internal market and trade with third countries, with further sub-divisions  Allows equivalent rules covering several sectors to be gathered together into a single provision, and rules specific to individual sectors to be located in an appropriate, easy-to-find place  The proposal for the integration of wine into the single CMO follows this logic Brussels, 8 - 9 January 2009

8 Integration methods  Some wine provision already covered by sCMO today  Provisions identical for wine CMO and other products in single CMO: wine sector simply added to the list of products concerned  Provisions specific to wine sector cut-and- pasted into appropriate places in sCMO Brussels, 8 - 9 January 2009

9 Product list  Already covered in sCMO today  Wine sector listed in Article 1(l) sCMO  Products list concerned in Part XII of Annex I sCMO  Order of sectors followed in all subsequent cases in sCMO Brussels, 8 - 9 January 2009

10 Management committee  Single CMO Management Committee already applies to wine sector from 1 August 2008  Working well: wine issues grouped together for single day's discussion  Already used for opinions on many proposals implementing wine reform Brussels, 8 - 9 January 2009

11 Management committee powers  In all old CMOs (including wine): "the Commission may act by the management committee procedure".  New drafting in sCMO: "the Commission may act" but read with Article 4 sCMO, so always by management committee procedure unless the sCMO says otherwise explicitly.  So no change in substance: committee will continue to be consulted on the same issues as under the wine CMO. Brussels, 8 - 9 January 2009

12 Identical provisions wine/CMO  Wine added to identical sCMO provisions: –scope of sCMO: Article 1(2) –marketing years: Article 3 –tariff nomenclature: Article 129 –import licences: Article 130 –additional import duties: Article 141 –suspension of inward processing: Article 160 –export licences: Article 161 –suspension of outward processing: Article 174 –anti-trust competition rules: Article 175 Brussels, 8 - 9 January 2009

13 Wine sector definitions  Added without modification as a separate Part IIIa into the list for all sectors: Annex III sCMO Brussels, 8 - 9 January 2009

15 Support programmes  Wine sector support programmes are sector-specific aid schemes as for other products  So integrated unchanged as separate Section IVb in Chapter IV (aid schemes) under the headings for Internal Market (Part II), Market Intervention (Title I) sCMO  Related Annex on budgets is added as Annex Xb sCMO Brussels, 8 - 9 January 2009

17 Names, labelling, presentation  Wine-sector specific (designations of origin, geographical indications, traditional terms and labelling and presentation) but such rules exist for other sectors  So integrated unchanged in new Sections Ia and Ib of Chapter I (Rules concerning marketing and production) in Title II of Part II sCMO Brussels, 8 - 9 January 2009

18 Production rules  Sector-specific (wine grape varieties and oenological practices and restrictions) but such rules exist for other sectors  So integrated into new Section IIa of Chapter I (Rules concerning marketing and production) in Title II of Part II sCMO  Related Annexes XVa and XVb sCMO added Brussels, 8 - 9 January 2009
