7 Proposed Minimum Site Standards Based on the 1999 SREF benchmarks: Elementary School: 11 Acres – Minimum four acres for first two hundred (200) student capacity. – One acre for each additional one hundred (100) students. Middle School: 16 Acres – Minimum six acres for first three hundred (300) student capacity. – One acre for each additional one hundred (100) students. High School: 39 Acres – Minimum seven acres for first three hundred (300) student capacity. – One acre for each additional fifty (50) students up to one thousand (1,000) students. – One acre for each additional one hundred (100) students thereafter.

25 Public School Signage Public School Siting Ordinance  Does not include sign standards – Currently approved administratively case by case – Advertisements solely for school functions  Proposed amendments – Approve based on Zoning District – Limit EMC copy area to 32 sq.ft. – No EMC in close proximity to SFR’s – Advertisements solely for school functions

26 Public Schools & Restaurants In urban areas, alcohol distance separation is too onerous on restaurants.  Current code requires a minimum 1,000 ft. separation  State law requires a minimum 500 ft. separation for bars  Recent variances approved by BCC – China Garden Restaurant – Kung-Fusion Restaurant

27 Public Schools & Restaurants (Cont.) Proposed Changes:  Reduce distance separation to 500 ft. for restaurants only  Amend Section 38-1415(e) to measure distance from main entrance of school instead of from nearest point of school grounds  Extend loss of non-conformity of use to a period of two years instead of 6 months for pre-existing restaurant only  Allow less separation in Activity Center Mixed Use (ACMU) designation

28 Hearing Officer Concept Proposed 38-1758: Review of Public School Sites 1.Pre-Submittal Conference - Staff from OCPS and County review proposed site and identify any issues with proposed site. 2.Pre-Acquisition Notice - Notice sent from OCPS to County requesting a comprehensive plan consistency determination. a.Planning and Zoning Commission/Local Planning Agency to determine consistency of site with Comprehensive Plan; and b.Planning Division Manager to determine consistency of site with PSSR’s

29 Hearing Officer Concept (cont.) 3. After being forwarded determination, County Administrator contacts hearing officer to schedule a public hearing. Hearing officer takes public comment, considers the two determinations, and issues findings of fact and conclusions of law. Hearing officer may impose reasonable conditions per 1013.51, Florida Statutes. Hearing officer’s determinations are then submitted to County and OCPS.

30 Hearing Officer Concept (cont.) 4. OCPS holds public hearing to consider whether to accept or reject hearing officer’s determination. 5. BCC may accept hearing officer’s recommendations as a consent agenda item or may reject a portion of or all of the recommendations.

31 Hearing Officer Concept (cont.)  Development Plan Approval 1.OCPS to submit a Development Plan to County Administrator at least 90 days prior to construction of a new school. 2.Within 45 days of submittal of the Development Plan, County shall certify to OCPS, in writing, whether proposed Development Plan meets requirements of hearing officer’s determinations.

32 Hearing Officer Concept (cont.)  Alternative Process 1.Pre-conference with staff 2.OCPS sends Pre-Acquisition Notice requesting consistency finding 3.Planning Division Review 4.Planning and Zoning Commission/Local Planning Agency recommendation of comprehensive plan consistency 5.Board of County Commissioners’ Public Hearing on consistency determination (Quasi-Judicial)

33 Charter School Standards  Per Section 1002.33 F.S., charter schools are a type of public school.  Charter schools are not included in the School Siting Ordinance.  Charter schools are special exceptions in all residential zoning districts and permitted in non-residential zones.

34  Currently, no site requirements for charter schools  Recommend adding site requirements only for charter schools in excess of 800 students.  Charter schools that meet the public school site requirements would be a permitted use. Charter School Standards (cont.)
