1 CASE STUDY Equal Pay for Work of Equal Value The business Challenge Intelligent data informing strategic, pro-active decision making in terms of remuneration and reward. The introduction of the right to ‘equal pay for work of equal value’, has been added as a sub clause to Section 6 of the Employment Equity Act and came into effect 1 August 2014. This means that it is against the law to discriminate unfairly between the remuneration and working conditions of employees doing the same work or work of equal value. The Act requires that all South African employers analyse pay by using an accepted methodology or system that can determine the size of their jobs and the shape of their pay curve, and that can ‘methodologically’ or ‘statistically’ determine whether or not the differences in pay are capable of rational explanation where the notion of ‘not less favourable’ will apply. EOH’s client has strategies and processes in place to address the above but did not have the solution to monitor the application of these strategies (performance management, remuneration policy and procedures, pay scale application etc.) The client wants to be able to determine whether any discriminatory practices exist within any business unit/s in terms of pay equity. ABOUT THE CLIENT A global metals and mining company, operating across Australia, Southern Africa and South America, with more than 7 700 employees across business units in South African alone. INDUSTRY Mining BUSINESS CHALLENGE The client required a management solution to be informed them on current remuneration practices and possible anomalies and discrepancies in terms of pay equity across all business units in South Africa. This management solution would inform strategic decision-making in terms of remuneration and reward and would adhere to South African Employment Equity legislation and guidelines. EOH SOLUTION Design and implementation of an Equal Pay for Work of Equal Value management solution dashboard enabling the client to pro-actively manage any risk factors related to pay equity. BUSINESS IMPACT Provide management with insight into the application of remuneration policies, procedures and systems in the workplace Highlight risk areas that could have potentially led to legal action against the client Enable management to act pro-actively put strategies / measures in place to eliminate any possible pay inequities. `

2 The Solution A management dashboard solution designed to enable management to monitor and manage policies, practice and procedures by providing intelligent comparative data that will be useful in making informed decision based on equal pay for work of equal value. The project consisted of the following implementation steps: 1.In-depth analysis and research done on applicable legislation and code of good practice 2.Management Solution Dashboard design. The dashboard compares the basic salary as well as total guaranteed packages of all employees within specified groupings (prohibiting factors as stated by the Act like, race, gender, disability etc.) as well as justifiable discriminators (skills, qualifications, tenure, performance etc.) are considered. 3.Dashboard customisation in terms of the client’s payroll data, reporting requirements etc. 4.Training provided to the client in terms of Employment Equity Act and the operation /execution of the dashboard solution.
