10. Regarding service to ELLs, DOJ generally considers three factors (from Castaneda v. Pickard) when investigating or prosecuting violations: 1. Whether the school’s program is based upon sound educational theory or principles; 2. Whether the school’s program is reasonably calculated to implement the educational theory effectively; and 3. Whether, after a period of time sufficient to give the program a legitimate trial, the results of the program show that language barriers are actually being overcome. Department of Justice (DOJ)

To serve ELLs, Districts and Schools must:  Identify students who need assistance;  Develop a program which, in the view of experts in the field, has a reasonable chance for success;  Ensure that necessary staff, curricular materials and facilities are in place and used properly;  Develop evaluation standards, including program exit criteria, for measuring the progress of students; and  Assess the success of the program and modify it where needed.
