2 SB 504 Requirements :  Make recommendations concerning criteria for all districts to develop their policy to serve ELs;  Submit policy criteria recommendations to State Board on or before January 1, 2015; and  Review annually each district policy to serve ELs District EL Policy Subcommittee

10 Regarding service to ELLs, DOJ generally considers three factors (from Castaneda v. Pickard) when investigating or prosecuting violations: 1. Whether the school’s program is based upon sound educational theory or principles; 2. Whether the school’s program is reasonably calculated to implement the educational theory effectively; and 3. Whether, after a period of time sufficient to give the program a legitimate trial, the results of the program show that language barriers are actually being overcome. Department of Justice (DOJ)

11 To serve ELLs, Districts and Schools must:  Identify students who need assistance;  Develop a program which, in the view of experts in the field, has a reasonable chance for success;  Ensure that necessary staff, curricular materials and facilities are in place and used properly;  Develop evaluation standards, including program exit criteria, for measuring the progress of students; and  Assess the success of the program and modify it where needed.
