4 COMMON CRIMES AGAINST PEOPLE— MURDER MANSLAUGHTER ASSAULT BATTERY KIDNAPPING DOMESTIC VIOLENCE

5 MURDER INTENTIONAL KILLING OF ANOTHER PERSON

6 FIRST DEGREE MURDER INVOLVES ONE OR MORE OF THE FOLLOWING CIRCUMSTANCES— 1. Killing After Making a Detailed Plan to Kill 2. Killing In An Especially Vicious Way (ex. Torture) 3. Killing While Committing Another Serious Crime

7 If None Of These Conditions Apply, the Crime May Be Second- Degree Murder *************** The distinction between first- and second-degree is important because some states have the death penalty for first-degree murder

8 MANSLAUGHTER KILLING ANOTHER PERSON WITHOUT INTENDING TO DO SO Voluntary-Killing someone while in a state of great distress and without a prior plan Involuntary-Killing someone accidentally while committing an unlawful or reckless act

9 ASSAULT AND BATTERY BATTERY--UNLAWFUL TOUCHING OF ANOTHER PERSON ASSAULT—ATTEMPT TO COMMIT A BATTERY Ex. Pointing or shooting a gun at someone is the assault; the bullet striking the person is the battery.

10 Act of Battery is to Recklessly Endanger Safety Bodily Harm is the impairment or intent to cause great bodily harm. Great Bodily Harm is the permanent disfigurement of someone or to have the risk of death. Substantial Bodily harm is to cause lacerations needing stitches, broken teeth, etc.

11 BATTERY --Forceful use, however slight, of a person’s hand, of a weapon, or other instrument against another person Battery may be committed by ordering a dog to attack a person or even kissing someone who does not want to be kissed!!

12 ASSAULT WAVING A BASEBALL BAT AT SOMEONE IS ASSAULT— HITTING THE PERSON WITH THE BASEBALL BAT IS BATTERY *SIMPLE ASSAULT AND BATTERY ARE MISDEMEANORS **AGGRAVATED ASSAULT AND BATTERY ARE FELONIES—To Be Aggravated, the Crime Must Be Committed With A Deadly Weapon or with the Intent To Commit Murder, Rape, or Robbery

13 KIDNAPPING THE UNLAWFUL REMOVAL OR RESTRAINT OF A PERSON AGAINST HIS OR HER WILL. Victim is either threatened or forced to be a captive

14 Kidnapping usually includes unlawful imprisonment for ransom, terrorism, torture, rape or to commit a felony. The distance involved in the unlawful movement does NOT matter! The essence of the crime is illegally imprisoning rather than moving the victim.

15 SEX OFFENSES CRIME OF RAPE—ONE PERSON FORCING ANOTHER TO HAVE SEXUAL INTERCOURSE. Law applies to both men and women

16 STATUTORY RAPE—HAVING SEXUAL INTERCOURSE WITH A MINOR WITH OR WITHOUT FORCE --A Minor Can Be Prosecuted For Having Sex With Another Minor --Sexual Assault by a Friend or a Date is a Sexual Offense called Date Rape or Acquaintance Rape

17 DOMESTIC VIOLENCE ANY RECKLESS FORM OF PHYSICAL OR MENTAL HARM IN A FAMILY OR HOUSEHOLD *********** Laws Protect Children, Spouses, and Family Members From: Neglect Mental Abuse Physical Abuse (By Another Member of the Family or Household)

18 CHILDREN ARE PROTECTED BY CHILD ENDANGERMENT AND CHILD ABUSE LAWS. **************** ABUSED SPOUSES MAY REQUEST A COURT ORDER TO STOP AN ABUSING SPOUSE FROM COMING NEAR THEM. This is called a Restraining Order.

24 PETTY LARCENY— --A MISDEMEANOR --STEALING PROPERY OF A SMALL MONETARY VALUE GRAND LARCENY— --A FELONY --STEALING PROPERTY VALUED AT MORE THAN A STATE’S LIMIT FOR PETTY LARCENY

25 ROBBERY THE WRONGFUL TAKING OF SOMEONE’S PROPERTY BY THREATENING VIOLENCE OR USING VIOLENCE The Penalty for Robbery Is Greater Than the Penalty for Larceny!

26 VANDALISM WILLFUL OR MALICIOUS DAMAGE TO PROPERTY --Also called malicious mischief or criminal damage. --To be guilty of vandalism, a person does not have to be the one who actually does the damage. --Being a “Lookout”, Can Also Be Charged!

27 Under parental liability laws, the parents of vandals are also often required to pay for the damage done by their children. The amount of the parents’ liability is limited, ranging from $300-$1000

31 SHOPLIFTING THE STEALING OF GOODS FROM A STORE --Costly For Consumers! --In Some Instances, People May Be Charged With Shoplifting Just For Hiding Merchandise In Their Pants or Stuffing Them Under Their Clothing, Even Before They Leave The Store!

32 Shoplifting increases costs of merchandise by two to three percent! Hard to prove—a person just states that they intended to pay for item or hadn’t had a chance to pay.

33 Some states have laws regarding concealment on one’s person of an article offered for sale to be prima facie evidence of an evidence to steal. This means, the evidence is enough to legally establish a fact or a case.

34 Under these laws, the prosecution does not have to prove that the defendant had an intent to steal— the defendant would have to prove that he/she did NOT intend to steal!

35 Store owner’s have the right to detain a person in a reasonable manner if reasonable ground exists to think that the person is a shoplifter. Many owners wait until a person has left their store with the items so they are not sued for false arrest or false imprisonment!

38 MONEY LAUNDERING WHEN CRIMINALS OBTAIN LARGE AMOUNT OF MONEY ILLEGALLY, THEY NEED TO HIDE THE MONEY *Often Done By Putting Money Into Legal Businesses to Launder It* *Federal Government Has Passed Laws to Prosecute Anyone Involved In Money Laundering Even If They Did Not Steal The Money Themselves*

Rioting—Gathering of at least three individuals who threaten to harm people or to damage property, or who violently commit one or the other of those offenses

51 MOTOR VEHICLE VIOLATIONS DO YOU HAVE A RIGHT TO A DRIVER’S LICENSE?

52 A LICENSE TO DRIVE IS A PRIVILEGE, NOT A RIGHT. THAT PRIVILEGE CAN BE TAKEN AWAY IF ABUSED
