4 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization In March 2007 Government of Montenegro made the Decision on establishing the Institute for Standardization of Montenegro (ISME). Primary activity – adopting Montenegrin standards (MEST) and related documents, providing information on standards and their distribution for the needs of Montenegrin society and industry. Representing the interests of all interested parties, ISME aims to establish, maintain and develop standardization system in Montenegro following the requirements and recommendations of international and European standards organizations. 6 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization Legislative: ISME is recognized as the only national standards body dealing with standardization activities falling within the scope of CEN/CENELEC, ISO and IEC. ISME performs the activities in accordance with the Law, Decision on Establishment, general acts (Statute) and Internal Rules for Standardization following the rules of international and European standards organizations as well as World Trade Organization Code of Good Practice. Internal Rules for Standardization (ISME IPS): Part 1: Establishment and working procedure for technical bodies of the Institute Part 2: Types of the documents and their designation Part 3: Development of Montenegrin standards and related documents Part 4: Participation in the work of European standards organizations in the development of standards and related documents and adoption of European standards and related documents at national level Part 5: Participation in the work of international standards organizations in the development of standards and related documents and adoption of international standards and related documents at national level Part 6: Rules for the structure and drafting of documents Directive 98/34/EC requirements, amended by Directive 98/48/EC, are incorporated in ISME IPS. 8 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization Law on Standardization, Art 16 (“Official Gazette of Montenegro”, No. 13/08) prescribes the application of Montenegrin standards and related documents shall not be mandatory. Standards development is made via Technical Committees and technical bodies of ISME: ISME/TK 001: Petroleum and petroleum products ISME/TK 002: Eurocodes ISME/TK 003: Food products ISME/TK E 004: Energy management systems and Energy efficiency *ISME/TK 005: Human resource management ISME/TK E 006: Electroenergetics *ISME/TK 007: Social responsibility ISME/TK 008: Pressure equipment ISME/TK 010: Environment and environmental management systems ISME/TK 011: Tourism and related services ISME/TK 012: Devices and equipment for storage and transport ISME/TK 009: Construction products ISME follows the work of technical bodies of: CEN (71), CENELEC (13), ISO (47) Chapter 1: Free movement of goods

10 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization As regards international cooperation, ISME follows the operating of two policy committees: ISO (COPOLCO - Committee on consumer policy and DEVCO - Committee on developing countries matters). ISME follows and takes part in the work of ISO/IEC technical bodies in accordance with the national interests and interested parties needs. ISME delegation regularly takes part in ISO and IEC General meetings. ISME signed the Agreements on technical cooperation with the following national standards organizations: ISS (Serbia), BAS (Bosnia and Herzegovina), ISRM (Macedonia), SIST (Slovenia), HZN (Croatia) and DPS (Albania). ISME signed the Agreements on technical cooperation with DIN (Germany), BSI (Great Britain) and AFNOR (France). This cooperation allows interested parties to have insight into DIN’s, BSI’s and AFNOR’s standards and buy it in hard copy via ISME. Chapter 1: Free movement of goods

11 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization Up to the end of February 2013, ISME shall have acc. 9.620 Montenegrin standards and related documents out of which 7.145 are identical to CEN standards (74,25%), 2.150 to CENELEC standards (22,34%), and 236 are identical to ETSI standards (2,45%). The rest (0,96%) concerns to two national and international (ISO, IEC) standards. Chapter 1: Free movement of goods ISME continuously adopts international and European standards and related documents at national level as well as harmonized standards thus providing support to EU Directives transposition. As of 13.02.2013 ISME disposes of 2.967 harmonized MEST.

12 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization In accordance with the requirements of Directive 98/34/EC (Directive 98/48/EC), Internal Rules for Standardization (ISME IPS) establish ISME obligation to notify timely CEN/CENELEC of development all pure national standards and following “standstill" procedure of pure national projects if there is the work on that or similar CEN/CENELEC notification process. Chapter 1: Free movement of goods In May 2011 ISME started notification process toward CEN i CENELEC. As regards total number of European standards, up to now ISME notified 47,35% CEN, i.e. 34,77% CENELEC standards. New standardization projects notifications of CEN and CENELEC Full and Associate members are available at ISME website.

13 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization There are no conflicting standards in Montenegro. Law on Standardization, Art 10, Point 2, prescribes the usage of international and European standards and related documents as the basis for adoption of Montenegrin standards and related documents. ISME is led by CEN/CENELEC Guide 20, i.e. Criterion 5 regarding coherence in standardization: Avoid duplication and overlap with standardisation at European level (CEN/CENELEC) Avoid duplication and overlap with standardisation at International level (ISO/IEC) Avoid duplication or conflict between sectors, within a Member’s work programme or collection of published standards, and with national legal requirements Be complementary to legal requirements. Up to now, ISME adopted the following two standards at national level: 1.MEST OHSAS 18001:2010 Occupational health and safety management systems – Requirements 2.MEST OHSAS 18002:2010 Occupational health and safety management systems - Guidelines for the implementation of OHSAS 18001:2007 Chapter 1: Free movement of goods

14 M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free movement of goods - Standardization There are 22 employees within ISME. There is a need of increasing the number of employees and defining financial scope in accordance with the draft Strategy for Standardization Development in Montenegro, being necessary for ISME proper functioning. Disregarding limited resources, ISME is dedicated to fulfilling the tasks in accordance with currently available capacity and financial resources. ISME shall submit the application for CEN/CENELEC Full membership 1-2 years prior to the term when Montenegro should become EU member. Chapter 1: Free movement of goods
