2 Civil Liberties The personal rights and freedoms that the federal government cannot abridge, either by law, constitution, or judicial interpretation.

3 Civil Rights The positive acts governments take to protect against arbitrary or discriminatory treatment by government or individuals.

5 The Incorporation Doctrine O The Bill of Rights was designed to limit the powers of the national government. O In 1868, the Fourteenth Amendment was added to the Constitution and its language suggested that the protections of the Bill of Rights might also be extended to prevent state infringement of those rights. O The amendment begins: “No state shall....deprive any person, of life, liberty, or property without due process of law.“” O The Civil Liberties contained in the Bill of Rights were then “incorporated” into the states by the Supreme Court on a case by case basis beginning with Gitlow v. New York in 1925.
