8 Provisions of rules TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 8 Options of subscribing : The Services shall be provided to the user upon concluding a Service Provision Contract with the Service provider or its authorized representative or by Conclusive Actions.

9 Provisions of rules: Tech. issues TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 9 In contract should be provided: The maximum time period, during which the provision of Services shall commence, in days or hours The information on the subscriber’s possibilities to use the services, provided by the institutions, providing on-call assistance services and on any restrictions of the on-call assistance services, including the information on the provision of the calling person’s location data to the Single Emergency Response Centre The information on any restrictions of the subscriber’s possibilities to use the Services and/or applications, in case such restrictions have been established by the Provider

10 Provisions of rules: Tech. issues (2) TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 10 The minimum quality of the offered Services, including the time of initial connection and other Service quality indicators The information on the procedures, applied by the Provider for the purpose of evaluating and regulating the flows in the public telecommunications network in order to avoid network overloads, as well as the information on the ways such procedures are able to affect the quality of the public telecommunications network The information on the technical maintenance services, offered by the Provider, including the conditions and time periods for elimination of Service interruptions in days or hours, the services of provision of assistance to the Service users and the ways to obtain the

11 Provisions of rules: Tech. issues (3) TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 11 The information on the settings of the terminal equipment, provided to the user by the Provider, which provide the terminal equipment the possibility to function without the will of the user when using the Services and the information on the possibilities to change such settings.

12 Provisions of rules: Price and contract validity TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 12 The prices of the Services, valid at the time of the conclusion of the Contract The time period for payment, for which a service charge is calculated The information on the Service credit limit, the conditions and procedure for changing the credit limit or the information that no Service credit limit is set The time period of validity of the Contract Max 24 months. The Provider also must ensure to service users the possibility to conclude the Contract for a time period, no longer than 12 months.

13 Provisions of rules: Price and contract validity TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 13 All the charges, payable when terminating the Contract, including the costs, incurred by the Provider when providing the terminal equipment, in case the Provider provided the terminal equipment according to the Contract. The difference of prices of sales of terminal equipment with a Contract and without a Contract All the charges, relating to transfer of telephone numbers and other identifiers or the information that no charges are applicable for such transfer. (legislation on number portability ensures this) A subscriber can terminate the Contract prior to its expiry in case the Provider changes the conditions of the Contract. Provider shall not have the right to apply any forfeit to the Subscriber.

14 Provisions of rules: Increased tariffs TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 14 The user, who completes a call to a telephone number, used for provision of an increased tariff service, prior to being provided the increased tariff service is informed on the tariffs, charged for the increased tariff service. The user is given the possibility to block the receipt of increased tariff services, provided by the telephone numbers of the 9XX XXXXX series and, in case of existence of technical feasibilities by other telephone numbers free of charge;

15 Information to end user TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 15 The Provider shall give the Service users the possibility to get comprehensive knowledge of the zone of operation of the electronic communications network of the Provider. Providers of public telephone communications services shall inform the user of public telephone communications services by a tone signal, prior to call setup on the fact that the subscriber is making a call to a network of another provider of public telephone communications services.

16 Provisions on SIM lock/unlock TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 16 In Contract: The information on any limitations of functioning of terminal equipment, provided to the user by the Provider, including the information that the terminal equipment, received by the user from the Provider will function only in the network of such Provider and not function in networks of other Providers or operators (SIM lock) After the user completely pays for the terminal equipment, intended for receipt of the Services, purchased from the Provider together with the Services, the Provider, at the request of the user, within the time period of one month as of the expiry of the Contract, shall unlock SIM free of charge.

17 Lost terminal TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 17 In the Contract the Provider shall specify the ways and time periods for blocking of provision of the Services to be employed in case the subscriber loses the terminal device. The Provider shall not be entitled to charge for provision of the service of blocking of Services. The Provider, upon receiving IMEI of a lost terminal device, shall terminate provision of the Services to the subscriber, using the terminal device, which IMEI corresponds to that of the lost terminal device. The Provider shall inform other providers of public mobile telephone communication services on IMEI of the lost terminal devices and the cases of termination of provision of Services.

18 SPAM TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 18 The Provider shall take all the measures possible in order to ensure that the Service user does not receive electronic messages (SMS or e-mails), sent for the purposes of direct marketing without advance consent of the Service user.

19 NRA’s role TAIEX Workshop 2014 Kosovo Virgilijus Stundžia 19 RRT is designated institution for resolving disputes between end-user and provider (before Court) RRT has regulatory power to protect end-users right (The rules) RRT has methodologies and equipment to evaluate if mobile telephony services are provide of adequate quality RRT has skillful personnel having technical, economical and legal background for resolving disputes
