2 Background In 1816, congress inaugurated the second national bank of the United States. Two years later the state of Maryland passed legislation to levy taxes on the bank. James McCulloch, a cashier at the bank, refused to pay taxes and, unwilling, brought the case to court where in a unanimous decision, won and did not have to pay taxes imposed on the bank.

3 Facts James MonroeDuring 1819, James monroe had already been president for two years when congress decided to charter the second national bank of the United States. The issue represented in the case was on the basis on whether or not the state of Maryland had a right to impose taxes on a national bank. Turns out they did not and James McCulloch did not have to pay the taxes that he rightly refused.

4 The Final Decision. The Supreme Court reached a unanimous decision that the state of Maryland had no right to impose taxes on the second national bank of the United states. However the state of Maryland argued that Congress had no privilege to charter the bank as a national bank. Congress then countered, stating they had the right to incorporate the bank and that “Maryland could not tax instruments of the national government employed in the execution of constitutional powers.
