2 What is Copyright? Form of protection for original works of authorship Establishes ownership of ideas as "Intellectual Property" Protects the financial rights of the author Provides incentives for Americans to conceive ideas

3 So what...? Copyright laws apply to everyone, including teachers, principals, and students Companies watch for copyright violation o Violations can be financially devastating to school districts Individuals who violate copyright law could face fines and imprisonment

4 What is protected? -Literary works -Musical works -Dramatic works -Pantomime and Choreography works -Pictorial, graphic, sculptural works -Motion pictures and other audiovisual works -Sound recordings -Architectural works

5 Length of Copyright Works created after 1978 are covered for the author's life, plus 70 years Before 1978, a total term of protection of 95 years

6 Fair Use Doctrine Copyright principle based on the belief that o the public is entitled to freely use portions of copyrighted materials o use for purposes of commentary and criticism Companies, educators, and judges have determined a general set of guidelines to allow use of copyrighted material on a limited basis

7 Fair Use Four factors that make it fair: 1. Purpose of use 2. Nature of use 3. Amount or Substantiality of Use 4. Market Effect of Use

8 Aren't Educators Exempt? Somewhat.... The Presentation or Performance of material must be: o by instructors or pupils o in the course of face-to-face teaching activities o is in a classroom or similar place devoted to instruction If ALL CONDITIONS are met, classroom exemption overrides any copyright warnings

9 What can I use? Public Domain: work whose intellectual property rights have expired, been forfeited, or are not applicable Works that contain "copyright free" disclaimers Works where permission is granted Information from most government sources Facts

10 Keep in Mind Can I defend what I am doing in a court of law? Am I saving money by doing this? If there is doubt, seek permission from the author!!

19 Helpful Tips o All documents should be ready for printing o Originals need sufficient margins o Leave margins for cutting if necessary o Pick-ups and deliveries happen once a day o Images look better when PRINTED rather than copied
