3 Draft Regulation on official controls to replace current Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules umbrella for official controls and other official activities related to food and feed safety, animal health and welfare, plant health, plant reproductive material and plant protection products to ensure a comprehensive and consistent approach to official controls along the agri-food chain new elements: –animal by-products –plant health –plant reproductive material and plant protection products Legislative package into force 2016 (Regulation on financial framework in 2014)

5 Harmonising official border controls Specific official controls shall be performed at Border Controls Posts (BCP) on live animals products of animal origin, germinal products and animal by-products goods requiring a temporary increased level of official controls due to a known or developing risk plants, plant products, other objects and material for which a phytosanitary certificate is required animals and goods subject to an emergency measure animals and goods where EU legislation requires compliance checks at the border Official controls certain categories of animals or products may be exempted by delegated acts from specific official controls; e.g. pets, goods sent as samples, products imported by travellers controlled at an appropriate place e.g. point of entry into the Union, BCP, point of release for free circulation in the Union, warehouses and the premises of the operator

6 Specific official controls at BCPs BCPs may specialise performed at the BCP of first arrival to EU –possibility to derogations: identity and physical check may be carried out at another BCP documentary, identity and physical check at the BCP –possibility to derogations: identity and physical checks may be carried out at control points other than BCP –100 % documentary and identity checks, frequency of physical checks based on risk checks carried out by competent authorities –physical checks to verify compliance with AH and AW by staff possessing appropriate qualifications in veterinary matters –physical checks on animals by official veterinarian used for all consignments –Trade Control and Expert System (TRACES) -> Information Management System for Official Controls (IMSOC) –Common Veterinary Entry Document (CVED) + Common Entry Document (CED) = Common Health Entry Document (CHED)

7 Financing of official controls Mandatory fees for official controls performed at BCPs and control points other than BCP on animals and goods entering EU to cover the salaries of the staff; costs of facilities and equipment, consumables, services and tools, training, travel, sampling and laboratory analysis, testing, diagnosis on a flat-rate basis or based on actual costs Reduction of fees ? for consistently compliant operators for microenterprises (<10 employees / 2 million € annual turnover)
