2 Keeping Children Safe in Education 2014 Replaces Safeguarding Children and Safer Recruitment in Education (Jan 2007) Replaces Allegations of Abuse made Against Teachers and Other Staff (Oct 2012)

3 Part 1 – Safeguarding for ALL Staff What is staying the same? All staff retain responsibility for: A safe environment Knowing the signs of abuse and what to look for Making referrals to Children’s Social Care Identifying children in need of extra help or at risk of significant harm Supporting social workers in making decisions Being aware of their school’s systems to support safeguarding

4 Part 1:What is staying the same cont’d Training – ALL staff (including the Head or Principal) must receive appropriate CP training which is regularly updated All school (and College) staff should know what to do if they have a concern about a child Types of abuse and neglect Specific Safeguarding issues: CSE, Bullying, DA, Drugs, Induced Illness, FGM and Forced Marriage

6 Part 1 – What’s New cont’d Staff members are advised to maintain an attitude of “it could happen here” where Safeguarding is concerned. When concerned about the welfare of a child the guidance clearly states: “Always act in the interests of the child”

7 Part 1 – What’s New cont’d Training: Must be in line with GSCB advice No timescales however GSCB has ratified decision that whole school training remains every 3 years (Working together 2010). Option to buy in to the LA’s Safeguarding Service for schools (Traded Services) continues to be an option.

8 Part 1 What’s New cont’d What should school staff do if they have a concern? Stresses Early Help i.e. Children receiving the right help at the right time Stresses learning for Serious Case Reviews both nationally and Locally Guidance provides a flowchart on Page 7. We have replicated this in the Newsletter accompanying today

9 Part 1 What’s New cont’d New issues included in the guidance: Faith abuse Gangs and Youth Violence Gender-based violence (violence against women and girls) Mental Health Private Fostering Radicalisation Sexting Teenage Relationship Abuse Trafficking

10 Part 2: The Management of Safeguarding- responsibilities of governing bodies and Proprietors What is not changing: Settings must comply with their statutory duties and must have regard to this guidance to ensure that their policies, procedures and training are effective and comply with the law at all times. There should be a nominated governor (usually the Chair) to liaise with the LA in the event of an Allegation being made against the Head Teacher (Direct to the LADO for Independent Schools) There must be an effective Safeguarding Policy There must be a member of the Leadership Team appointed as the DSL There must be at least one person on every selection and interview panel who is Safer Recruitment Accredited.

11 Part 2 – What is NOT changing The role of the DSL must include: Liaising with the LA and working with other agencies (Working Together 2013) Undergoing updated Safeguarding training every 2 years (Multi Agency as ratified by GSCB June 14)

12 Part 2 – What’s NOT changing Governing Bodies and Heads must ensure that: Staff members do not promise confidentiality to children (always act in the interests of the child). Appoint a Designated teacher for Looked After Children and ensure that this person is appropriately trained. Have in place arrangements for when a child goes missing.

13 Part 2: The Management o Safeguarding – responsibilities of governing bodies and proprietors What’s New? Heads and governing bodies must: Contribute to inter-agency working and CP Plans but also provide a co-ordinated offer of Early Help. Allow access to Social Care for them to conduct or consider a Section 17 or 47 assessment. The GSCB can require a school or college to supply information in order for it to perform its functions – this request must be complied with.

14 Part 2 – What’s New cont’d Heads and governing bodies should: Ensure there is an effective Staff behaviour policy (Code of Conduct) Review the Safeguarding Policy annually Ensure that there is always cover for the DSL role. Ensure Safer Recruitment is adhered to Ensure that a child’s wishes and feelings are taken into account when determining actions and systems are in place to enable children to express their views and feed back. Ensure staff are aware of keeping LAC safe and appropriate staff are aware of legal status of the child, contact arrangements, care arrangements, social worker and Virtual School.

15 Part 3 – Safer Recruitment What is NOT changing: Heads and Governing bodies must: – Act reasonably in making decisions about prospective employees. – DBS checks – Barred checks – Check interview information – Any information about past disciplinary action or allegations should be considered carefully when assessing suitability for the post. – Appointments should be conditional on pre-employment checks, verification of ID, DBS (+Barred List), Physical and Mental fitness, Right to work in the UK, Overseas checks and qualifications.

16 Part 3 – What is NOT changing The Single Central Record...... Continues to be required and must include: All staff including supply All others working in regular contact with children including volunteers. Everything on previous slide. For Independent schools (Including Academies and free Schools) the SCR must also include all members of the Proprietor Body.

17 Part 3: Safer Recruitment – What’s New? Application forms no longer required but written information about previous employment history remains Prohibition Checks – is this person still registered as a teacher? Each school registers with The Employer Access Online Service to identify prohibited teachers. Each school checks each new teacher in post Prohibition Orders are described in the National College for Teacher and leadership publication: Teacher Misconduct, the prohibition of Teachers. Prohibition checks must be carried out and must be added as a new column to the Single Central Record.

22 Remember DATA PROTECTION. The personal data available on the report is disclosed in order to allow your organisation to fulfil its remit and legal obligations. The data must not be passed to any third parties except those fulfilling a service on behalf of and under the expressed instructions of your organisation.

23 Part 3 – What’s new cont’d New section in the guidance for independent schools on the checks that must be carried out by the Secretary of State before someone can be the proprietor of an independent school Guidance on checks for position of the Chair of an Academy Trust if the Academy is converting from an LA maintained school New section re children staying with Host Families – DBS checks must be carried out if placement is arranged by the school.

24 Part 4: Allegations of abuse made against Teachers and other Staff What’s not changing? Allegations Management remains in place. KCSiE replaces the previous Allegations Guidance for schools issued in October 2012. What’s New? The guidance makes it clear that it relates to members of staff who are currently working in an education setting, regardless of where the alleged abuse took place.

25 Annex B – The Role of the DSL Considerably more detailed than previous guidance. All Heads, Chairs and governing Bodies need to consider this carefully. DSLs must now have a Job Description (JD). A bullet point list of things to include in the Job Description will be included on the GSCB website. It is the role of the head teacher to refer allegations to the LADO and not the DSL (anomaly in the guidance)

26 Summary This is good guidance! Main changes: Prohibition checks DCPO to DSL, always cover and must have a JD and proper time to do the job. All staff to support safeguarding Early Help and Voice of the Child

27 Gloucestershire’s Levels of Intervention Guidance Revised and updated in line with the requirements in Working Together to Safeguard Children 2013 Really important guidance document that assists with professional decision making according to the level of need Highlights the importance of early help and identifying children at risk of harm at the earliest possible stage

28 Why Do We Need It? To promote a common understanding of the type and level of support that is needed for children and young people based on their level of need To give examples of some of the concerns that you might have and the action that should be taken To signpost to other guidance and support, such as GSCB website, Family Information Service and South West Child Protection Procedures
