2  McFadden, a detective was patrolling when he saw two strangers on the street corner. He suspected the two of “casing a job” so he followed them. When they met up with a third man, McFadden approached them, told them he was an officer, and asked for their names. The three mumbled something and the officer patted down one of the men and found a pistol in the coat pocket. He removed the coat off of the man, took out the pistol, and made all three men face the wall with their hands raised. They were taken to the police station and charged with concealed weapons. ​

6  Whether a search for weapons without probable cause for arrest is considered an unreasonable search under the 4 th Amendment?

7  The Supreme Court ruled in favor of the state, Ohio  Why?  Because the 4 th Amendment applies to “stop and frisk” procedures  A warrant was not needed because it was an on-the-spot observation of the officer  The function of the search was for suspicious conduct, a legitimate reason  The officer took necessary measures to minimize the threat of physical harm OHIO

8  Precedent case  Court ruled that the police are allowed to “stop and frisk” a person if they have suspicion that the person is armed and/or dangerous  Police allowed to do a protective search  Overall: “Stop and frisks do not violate the Constitution under any circumstances”
