6 Class I Highlights TCEQ received 3 new Class I permit applications for new facilities in 2015 and anticipates receiving applications for Class I wells for one or two new facilities. Several Class I renewal, amendment, and minor modification applications are in process as are transfers. Similar to 2014, additional Class I applications were not able to initially be granted Railroad Commission “No-Harm” letters due to presence of newer petroleum reservoirs in Texas; this required Class I applicants to provide more detailed information to Railroad Commission for their evaluation. Class I well plugging and abandonment and new well installations were numerous in 2014 – 2016 and this trend will continue for the foreseeable future. Following 8 slides provide highlights of Class I wells such as well type, waste streams, injected volumes, locations, ages, well workovers.

16 Class III Highlights The continued decline in uranium yellow cake pricing has affected the uranium industry, and TCEQ’s permitting workload for in-situ uranium mines mirrors the industry slowdown. TCEQ’s UIC Program continued coordinating more closely with EPA Region 6 to facilitate EPA’s review/approval of UIC Program revision requests related to Aquifer Exemptions at Class III in-situ uranium mines. TCEQ began early coordination with EPA for the proposed Burke Hollow mine to provide technical information: proposed exemption, nearby wells, geology, groundwater flow, etc. EPA Region 6 approved 1 aquifer exemption related UIC Program revision request in 2015: La Palangaña Expansion (Requested 12/5/14; Approved 3/26/15)

18 Class V Highlights TCEQ requested UIC Special Project funding from EPA Region 6 and was granted a partial award for FY16 for a Class V authorization research/database update initiative: long-term focus on electronic data reporting to EPA Special grant project is underway and will include review of priority Class V authorization files, requests for updated information from regulated entities, and updating TCEQ’s databases TCEQ is doing rule revisions related to HB655 on Aquifer Storage and Recovery Wells (subject of following presentation by David Murry) TCEQ is doing rule revisions and other legislative implementation related to HB2230 authorizing dual-permitting Class II disposal wells and Class V injection wells for disposal of non-hazardous drinking water residuals and desalination concentrates; involves TCEQ – RRC coordination

19 Interface with Regulated Entities TCEQ continues to encourage permit applicants ask for pre- application meetings to clarify permitting requirements and improve application quality and completeness. In-process meetings may also be held to work through more complex issues. TCEQ participates in the Ground Water Protection Council on a national level and coordinates with industry associations such as Underground Injection Technology Council and Texas Mining and Reclamation Association to dialog with applicants and permittees on relevant UIC topics and provide updates/education opportunities. Periodic updates are made to TCEQ’s UIC Internet pages, including updates to applications.
